Definitely. That calf skin reduces abrasions too. Cops are so thoughtful before blasting into a citizens.

Funny, but police have the right to record audio and video without prior consent.

I will point out that the victim was unwise in both stepping out of the car at all and then making any non-lethargic movements. But the trigger-happy cop is also yelling "get out of the car" right before shooting him for ... leaping back out of the car.
The trooper actually lost his job and is being sued, so that is a major win, relatively.

^ I'm really curious about how this actually went. I'm pretty sure that with no law-enforcement witness, a summons can not be issued by the police. She can have the courthouse issue a summons where she is the plaintiff, not the police.

I agree that the shooting victim probably shouldn't have got out of the car in the first place, but surely the cop should have been much more circumspect and checked to see what the man was doing instead of simply opening fire with a volley of shots.

Is there so much fear amongst police nowadays in the US about the possibility of being shot that they'll shoot first, ask questions later?
 
Cop apologists blab so much about how cops could get killed any day (the same as you or I, and we don't have pistols on our sides) that the pigs start to actually believe it themselves. They are just fraidy cats too.
 
I think its slightly more subtle than that. This is the end result of petty power in force and being able to act with impunity. Cops almost never get in trouble for their actions, and live shielded within a fraternity where their own illegal behavior is covered up.

Police Officer Suspended After Tasering Unarmed 61-Year-Old Black Woman

Tallahassee police have placed officer Terry Mahan on paid administrative leave after video of him tasering unarmed 61-year-old Viola Young raised "enough concerns," Tallahassee Police Chief Michael DeLeo announced late Wednesday night. "They just tased a lady for nothing," the man heard in the video says. "They wonder why they're hated."

Young's tasering followed a swath of arrests made by police early Tuesday evening. Police Chief DeLeo told reporters that officers were patrolling the area where Young was tasered and three others were arrested as part of the department's "Community Oriented Policing and Problem Solving Squad," dispatched in response to complaints about open-air drug sales in the neighborhood. The video taken by a witness was released by police Wednesday night.

According to court documents obtained by the Tallahassee Democrat, officer Mahan first approached Quontarrious Jones, 23—who was walking in the street depicted in the video that has no visible sidewalk—ordering him to stop walking. Mahan arrested Jones on a resisting without violence charge.

While Jones was being arrested, Laguna Young, 41, and Quaneshia Rivers, 20, started shouting at officers—both were arrested by police on the same charge. (Young was also arrested for probation violation.)

After the arrests by police, Young approached officers, with court documents reporting her asking, "I just want to know what is going on." Mahan apparently responded by informing her she was under arrest, and after she attempted to walk away, fired a Taser into her back, causing her to fall to the ground.

"Viola Young caused me to take my focus off of one of the arrestees and engage her," Mahan wrote in a probable-cause affidavit to explain his decision to taser the woman. "Young's actions obstructed officers while in the course of completing their legal duties."

This is another strike against the Tallahassee Police Department for officers' use of violence in arrests. From the Tallahassee Democrat:

The incident was the latest to raise questions about TPD's use-of-force tactics. Earlier this month, Tallahassee city commissioners voted to settle a federal lawsuit for $475,000 brought by Christina West, a Tallahassee woman who suffered broken bones and other injuries during her DUI arrest in August 2013.

In that case, which was also caught on video, West alleged her civil rights had been violated and excessive force used during her arrest, which happened after she crashed her SUV into an unoccupied home. Four officers were suspended and one, Chris Ormerod, was later fired, though TPD said it was over unrelated traffic crashes.

The West case led to the ouster of TPD Chief Dennis Jones. DeLeo, hired late last year, has since been trying to repair the Police Department's relationship with the community. TPD also changed its use-of-force protocols, calling for officers to "de-escalate" encounters with citizens or suspects.

"My gut reaction is sort of like everyone else's—it looks like an instrument that is used to deter violence is being used as a weapon," Young's lawyer, Robert A. "Gus" Harper III, told the Democrat. "I think that goes against the spirit of the whole concept of tasers."

VIDEO: NYPD Officer Hits Unarmed Teen in the Face With His Gun

BROOKLYN — Two NYPD officers are under criminal investigation after punching and bashing a 16-year-old suspect in the face with a gun despite the teen raising his hands to surrender, according to a video obtained by DNAinfo New York.

The surveillance footage obtained exclusively by “On The Inside" shows the two officers catch up to marijuana suspect Kahreem Tribble after a brief chase in Bedford-Stuyvesant.

As the teen stops running, one officer throws a punch at his face. Then, as the suspect raises his hands, the other officer clocks him with his gun.

Tribble was arrested for possessing 17 small bags of marijuana and disorderly conduct on Aug. 29. At his arraignment, he pleaded guilty to a violation and was released with cracked teeth and bruises.

The officers from the 79th Precinct are now targets of a criminal investigation conducted by the NYPD’s Internal Affairs Bureau and Brooklyn District Attorney Kenneth Thompson.

“What’s depicted on this video is troubling and warrants a thorough investigation,” Thompson told “On The Inside."

According to court records, law enforcement sources and the video, the encounter started in front of 1311 St. John’s Place at 2:20 a.m. when three anti-crime officers spotted the 6-foot-2 teen peering into the window of parked mini-van.

When the officers got out of their car to approach Tribble, he allegedly tossed away a small black canvas bag and took off running. The officers — one with his gun drawn — gave chase, concerned that the suspect had a weapon, sources said.

Shortly thereafter, Tribble slows down and stops and appears prepared to be arrested. But an officer, identified as Tyrane Isaac, rushes up to him and takes a swing at his head.

The teen ducks the blow and then can be seen retreating — with his hands up — to a storefront gate.

Officer David Afanador — his gun drawn — then catches up and rushes straight to Tribble, hitting him in the his face with his gun, breaking a front tooth and chipping another.

On the video, Afanador then holsters his weapon and retraces his steps to retrieve the canvas bag, leaving Isaacs to put the cuffs on Tribble.

But before he does, Isaac punches Tribble again and pushes him onto his stomach.

The video ends with Afanador waving the bag in front of Tribble’s face before smacking him with it.

A third officer, identified as Christopher Mastoros, can be seen taking no action to help Tribble.

Police Commissioner William Bratton has seen the video and was angered and embarrassed by it, a source said.

Sources say officials were particularly concerned about Afanador using his gun on the teen because it could have accidentally fired — injuring or killing him, another officer or an innocent bystander.

Afanador has been suspended without pay. Isaac was placed on modified duty, stripped of his badge and gun.

Both officers have been on the force for nine years and now face possible criminal charges and dismissal, sources say.

Mastoros, also a nine-year veteran, could face a departmental charge for failing to stop his colleagues, sources say. He is not part of the criminal probe.

Each of the officers has two other cases lodged against them by defendants alleging false arrest or being victims of excessive force, according to court records. The cases were not connected.

Mastoros made news two years ago when he was credited with helping save the life of a partner, Kevin Brennan, who survived being shot in the head after chasing a gunman into a Bushwick building.

The video is the latest to surface since the viral video of the tragic “choke hold” death of Eric Garner. Last week, Bratton told a confab of top NYPD officials that he was committed to rooting out bad apples engaged in brutality and corruption.

Sources say Internal Affairs was tipped off to the Tribble video a few days after his arrest. Roughly two weeks ago, IAB supervisors brought their findings to Thompson to determine if criminal charges are warranted.

Patrick Lynch, the police union president, said the tape does not tell the entire tale.

“As usual, the video fails to capture the offense that resulted in police action or the lengthy foot pursuit that culminated in the arrest," he said.

"Situations like this one happen in real time under great stress. It’s very easy to be judgmental in the comfort of an office while sitting in front of a video screen."

Tribble’s lawyer, Amy Rameau, told "On The Inside" that her client was heading home from a friend's apartment when the officers chased him.

"My client was minding his own business and they decided to chase him for no reason," she said. "Their account is concocted to justify what they did, to cover their asses, to legitimize their criminal conduct."

She said in addition to suffering broken teeth, Tribble was bleeding from his mouth and "begging for medical attention," but was only sent to Interfaith Hospital when other officers at Central Booking saw him.

She said she plans to file a federal civil rights lawsuit against the NYPD and the officers.

The clash has left the teen "petrified" of police and "traumatized and fearful that they will come after him again."

Nineteen-month-old Bounkham "Bou Bou" Phonesavanh's nose was detached from his face after a stun grenade landed in his playpen during the raid, carried out by a Habersham SWAT team in May. According to an incident report obtained from the Habersham sheriff's office, deputies were told to anticipate a cache of weapons and armed guards at the home.

No drugs or weapons were found in the home, and the suspect, Wanis Thonetheva, was arrested later at another house, with only a small amount of methamphetamine in his possession.

Habersham County has refused to pay for Phonesavanh's medical care, saying in August that "it would be in violation of the law for it to do so."

The parents of a Wake County high school student are outraged that police pepper-sprayed him inside their home after a neighbor mistook him for an intruder.

It happened Monday afternoon on England Avenue in Fuquay-Varina.

Ricky and Stacy Tyler have fostered 18-year-old DeShawn Currie for about a year. The Tylers, their three young children and DeShawn moved to Fuquay-Varina in July. They said while they're still getting to know their neighbors, it's hurtful someone would assume DeShawn was a burglar just for going about his normal routine of walking home after school.

"He's my baby boy just as much as my other three children are," said Stacy.

She left the side door to their home unlocked Monday for DeShawn, who was coming home early from school.

Fuquay-Varina police said when a neighbor saw DeShawn walk in; they called 911 to report a break-in. Soon, three officers were inside the house, all to DeShawn's surprise.

"They was like, 'Put your hands on the door,'" said DeShawn. "I was like, 'For what? This is my house.' I was like, 'Why are y'all in here?'"

DeShawn said he became angry when officers pointed out the pictures of the Tyler's three younger children on the mantle, assuming he didn't belong there. An argument ensued and DeShawn said one of the officers pepper-sprayed him in the face.

By the time Stacy came home, EMS were treating DeShawn in the driveway. She cleared up the confusion with the officers, but not with the rest of her family.

"My 5-year-old last night, she looked at me and said, 'Mama I don't understand why they hated our brother, and they had to come in and hurt him.'"

"Everything that we've worked so hard for in the past years was stripped away yesterday in just a matter of moments," said Ricky Tyler.

DeShawn said he chose this family with a hope of security and love, but now he's not sure if he'll ever be able to move on.

"I'm feeling comfortable," explained DeShawn. "I had moved into my room, and I'm feeling like I'm loved. And then when they come in and they just profile me and say that I'm not who I am. And that I do not stay here because there was white kids on the wall, that really made me mad."

Fuquay-Varina police released a statement Monday saying officers responded to a report of suspicious criminal activity at the Tyler's home.

Officers said DeShawn became threatening and belligerent. When he would not follow the officers' instructions, they pepper-sprayed him.

Police also point out in their statement that the neighborhood where this happened has recently experienced criminal activity.

The Tylers and DeShawn met with Captain Bob Adams with the Fuquay-Varina Police Department Tuesday afternoon for a couple of hours.

No charges have been filed.
