NSA collects millions of e-mail address books globally

The National Security Agency is harvesting hundreds of millions of contact lists from personal e-mail and instant messaging accounts around the world, many of them belonging to Americans, according to senior intelligence officials and top secret documents provided by former NSA contractor Edward Snowden.

The collection program, which has not been disclosed before, intercepts e-mail address books and “buddy lists” from instant messaging services as they move across global data links. Online services often transmit those contacts when a user logs on, composes a message, or synchronizes a computer or mobile device with information stored on remote servers.

Rather than targeting individual users, the NSA is gathering contact lists in large numbers that amount to a sizable fraction of the world’s e-mail and instant messaging accounts. Analysis of that data enables the agency to search for hidden connections and map relationships within a much smaller universe of foreign intelligence targets.

During a single day last year, the NSA’s Special Source Operations branch collected 444,743 e-mail address books from Yahoo, 105,068 from Hotmail, 82,857 from Facebook, 33,697 from Gmail and 22,881 from unspecified other providers, according to an internal NSA PowerPoint presentation. Those figures, described as a typical daily intake in the document, correspond to a rate of more than 250 million per year.

Each day, the presentation said, the NSA collects contacts from an estimated 500,000 buddy lists on live-chat services as well as from the “in-box” displays of Web-based e-mail accounts.

The collection depends on secret arrangements with foreign telecommunications companies or allied intelligence services in control of facilities that direct traffic along the Internet’s main data routes.

Although the collection takes place overseas, two senior U.S. intelligence officials acknowledged that it sweeps in the contacts of many Americans. They declined to offer an estimate but did not dispute that the number is likely to be in the millions or tens of millions.

A spokesman for the Office of the Director of National Intelligence, which oversees the NSA, said the agency “is focused on discovering and developing intelligence about valid foreign intelligence targets like terrorists, human traffickers and drug smugglers. We are not interested in personal information about ordinary Americans.”

The spokesman, Shawn Turner, added that rules approved by the attorney general require the NSA to “minimize the acquisition, use, and dissemination” of information that identifies a U.S. citizen or permanent resident.

The NSA’s collection of nearly all U.S. call records, under a separate program, has generated significant controversy since it was revealed in June. The NSA’s director, Gen. Keith B. Alexander, has defended “bulk” collection as an essential counterterrorism and foreign intelligence tool, saying “you need the haystack to find the needle.”

Contact lists stored online provide the NSA with far richer sources of data than call records alone. Address books commonly include not only names and e-mail addresses but also telephone numbers, street addresses, and business and family information. In-box listings of e-mail accounts stored in the “cloud” sometimes contain content such as the first few lines of a message.

Taken together, the data would enable the NSA, if permitted, to draw detailed maps of a person’s life, as told by personal, professional, political and religious connections. The picture can also be misleading, creating false “associations” with ex-spouses or people with whom an account holder has had no contact in many years.

The NSA has not been authorized by Congress or the special intelligence court that oversees foreign surveillance to collect contact lists in bulk, and senior intelligence officials said it would be illegal to do so from facilities in the United States. The agency avoids the restrictions in the Foreign Intelligence Surveillance Act by intercepting contact lists from access points “all over the world,” one official said, speaking on the condition of anonymity to discuss a classified program. “None of those are on U.S. territory.”

Because of the method employed, the agency is not legally required or technically able to restrict its intake to contact lists belonging to specified foreign intelligence targets, he said.

When information passes through “the overseas collection apparatus,” the official added, “the assumption is you’re not a U.S. person.”

In practice, data from Americans is collected in large volumes — in part because they live and work overseas, but also because data crosses international boundaries even when its American owners stay at home. Large technology companies, including Google and Facebook, maintain data centers around the world to balance loads on their servers and work around outages.

A senior U.S. intelligence official said that the privacy of Americans is protected, despite mass collection, because “we have checks and balances built into our tools.”

NSA analysts, he said, may not search or distribute information from the contacts database unless they can “make the case that something in there is a valid foreign intelligence target in and of itself.”

In this program, the NSA is obliged to make that case only to itself or others in the executive branch. With few exceptions, intelligence operations overseas fall solely within the president’s legal purview. The Foreign Intelligence Surveillance Act, enacted in 1978, imposes restrictions only on electronic surveillance that targets Americans or takes place on U.S. territory.

By contrast, the NSA draws on authority in the Patriot Act for its bulk collection of domestic phone records, and it gathers online records from U.S. Internet companies, in a program known as PRISM, under powers granted by Congress in the FISA Amendments Act. Those operations are overseen by the Foreign Intelligence Surveillance Court.

Sen. Dianne Feinstein (D-Calif.), chairman of the Senate Intelligence Committee, said in August that the committee has less information about, and conducts less oversight of, intelligence-gathering that relies solely on presidential authority. She said she planned to ask for more briefings on those programs.

“In general, the committee is far less aware of operations conducted under 12333,” said a senior committee staff member, referring to Executive Order 12333, which defines the basic powers and responsibilities of the intelligence agencies. “I believe the NSA would answer questions if we asked them, and if we knew to ask them, but it would not routinely report these things, and in general they would not fall within the focus of the committee.”

Because the agency captures contact lists “on the fly” as they cross major Internet switches, rather than “at rest” on computer servers, the NSA has no need to notify the U.S. companies that host the information or to ask for help from them.

“We have neither knowledge nor participation in any mass collection of webmail addresses or chat lists by the government,” said Google spokesman Niki Fenwick.

At Microsoft, spokesman Nicole Miller said the company “does not provide any government with direct or unfettered access to our customers’ data,” adding that “we would have significant concerns if these allegations about government actions are true.”

Facebook spokesman Jodi Seth said “we did not know and did not assist” in the NSA’s interception of contact lists.

It is unclear why the NSA collects more than twice as many address books from Yahoo than the other big services combined. One possibility is that Yahoo, unlike other service providers, has left connections to its users unencrypted by default.

Suzanne Philion, a Yahoo spokesman, said Monday in response to an inquiry from The Washington Post that, beginning in January, Yahoo would begin encrypting all its e-mail connections.

Google was the first to secure all its e-mail connections, turning on “SSL encryption” globally in 2010. People with inside knowledge said the move was intended in part to thwart large-scale collection of its users’ information by the NSA and other intelligence agencies.

The volume of NSA contacts collection is so high that it has occasionally threatened to overwhelm storage repositories, forcing the agency to halt its intake with “emergency detasking” orders. Three NSA documents describe short-term efforts to build an “across-the-board technology throttle for truly heinous data” and longer-term efforts to filter out information that the NSA does not need.

Spam has proven to be a significant problem for NSA — clogging databases with data that holds no foreign intelligence value. The majority of all e-mails, one NSA document says, “are SPAM from ‘fake’ addresses and never ‘delivered’ to targets.”

In fall 2011, according to an NSA presentation, the Yahoo account of an Iranian target was “hacked by an unknown actor,” who used it to send spam. The Iranian had “a number of Yahoo groups in his/her contact list, some with many hundreds or thousands of members.”

The cascading effects of repeated spam messages, compounded by the automatic addition of the Iranian’s contacts to other people’s address books, led to a massive spike in the volume of traffic collected by the Australian intelligence service on the NSA’s behalf.

After nine days of data-bombing, the Iranian’s contact book and contact books for several people within it were “emergency detasked.”

In a briefing from the NSA’s Large Access Exploitation working group, that example was used to illustrate the need to narrow the criteria for interception of data. It called for a “shifting collection philosophy”: “Memorialize what you need” vs. “Order one of everything off the menu and eat what you want.”

Of course they know. They're clearly monitoring it. You'd have to be pretty stupid to play around in there. I wouldn't even know how to find this deep web and wouldn't want to.
 
So you're saying the country with the most resources can willfully and without cause violate a citizen's rights and violate law better? I'll agree with that if that's what you're saying.

This isn't about protecting anyone or anything. It's about control and nothing more. It's one of the oldest political con games in the book.

Its the titillation of being in one of these insider networks. The CIA, NSA, all these 'secret clubs' attract people that want to feel special, they're suddenly insiders just by getting a job. Any low level analyst can play along, walking down the street feeling important because they know have access to all these secrets that you don't. The higher it goes, the more imbued with special access and privileged you have.

Its pervasive across government, not just secret agencies. Aides that work for congressmen, supreme court interns, white house aides... all phony insiders.
 
I find it incredulous that world leaders are up in arms as if they just realized Santa Claus does not exist.

Whether it is ethical or not is up to interpretation and discussion, but a lack of pragmatism should not be. As the article I read in Time said, the countries moaning about it are only doing so because they are jealous they don't have the same capabilities.

Why anyone would think the USA's obsession with national security wouldn't do this is beyond me. You can bet they are spying on everything and everyone. If you're a congressman, supreme court justice, world leader.... you'd be stupid to think they're not.

Documents Reveal Top NSA Hacking Unit

The NSA's TAO hacking unit is considered to be the intelligence agency's top secret weapon. It maintains its own covert network, infiltrates computers around the world and even intercepts shipping deliveries to plant back doors in electronics ordered by those it is targeting.

In January 2010, numerous homeowners in San Antonio, Texas, stood baffled in front of their closed garage doors. They wanted to drive to work or head off to do their grocery shopping, but their garage door openers had gone dead, leaving them stranded. No matter how many times they pressed the buttons, the doors didn't budge. The problem primarily affected residents in the western part of the city, around Military Drive and the interstate highway known as Loop 410.

In the United States, a country of cars and commuters, the mysterious garage door problem quickly became an issue for local politicians. Ultimately, the municipal government solved the riddle. Fault for the error lay with the United States' foreign intelligence service, the National Security Agency, which has offices in San Antonio. Officials at the agency were forced to admit that one of the NSA's radio antennas was broadcasting at the same frequency as the garage door openers. Embarrassed officials at the intelligence agency promised to resolve the issue as quickly as possible, and soon the doors began opening again.

It was thanks to the garage door opener episode that Texans learned just how far the NSA's work had encroached upon their daily lives. For quite some time now, the intelligence agency has maintained a branch with around 2,000 employees at Lackland Air Force Base, also in San Antonio. In 2005, the agency took over a former Sony computer chip plant in the western part of the city. A brisk pace of construction commenced inside this enormous compound. The acquisition of the former chip factory at Sony Place was part of a massive expansion the agency began after the events of Sept. 11, 2001.

On-Call Digital Plumbers

One of the two main buildings at the former plant has since housed a sophisticated NSA unit, one that has benefited the most from this expansion and has grown the fastest in recent years -- the Office of Tailored Access Operations, or TAO. This is the NSA's top operative unit -- something like a squad of plumbers that can be called in when normal access to a target is blocked.

According to internal NSA documents viewed by SPIEGEL, these on-call digital plumbers are involved in many sensitive operations conducted by American intelligence agencies. TAO's area of operations ranges from counterterrorism to cyber attacks to traditional espionage. The documents reveal just how diversified the tools at TAO's disposal have become -- and also how it exploits the technical weaknesses of the IT industry, from Microsoft to Cisco and Huawei, to carry out its discreet and efficient attacks.

The unit is "akin to the wunderkind of the US intelligence community," says Matthew Aid, a historian who specializes in the history of the NSA. "Getting the ungettable" is the NSA's own description of its duties. "It is not about the quantity produced but the quality of intelligence that is important," one former TAO chief wrote, describing her work in a document. The paper seen by SPIEGEL quotes the former unit head stating that TAO has contributed "some of the most significant intelligence our country has ever seen." The unit, it goes on, has "access to our very hardest targets."

A Unit Born of the Internet

Defining the future of her unit at the time, she wrote that TAO "needs to continue to grow and must lay the foundation for integrated Computer Network Operations," and that it must "support Computer Network Attacks as an integrated part of military operations." To succeed in this, she wrote, TAO would have to acquire "pervasive, persistent access on the global network." An internal description of TAO's responsibilities makes clear that aggressive attacks are an explicit part of the unit's tasks. In other words, the NSA's hackers have been given a government mandate for their work. During the middle part of the last decade, the special unit succeeded in gaining access to 258 targets in 89 countries -- nearly everywhere in the world. In 2010, it conducted 279 operations worldwide.

Indeed, TAO specialists have directly accessed the protected networks of democratically elected leaders of countries. They infiltrated networks of European telecommunications companies and gained access to and read mails sent over Blackberry's BES email servers, which until then were believed to be securely encrypted. Achieving this last goal required a "sustained TAO operation," one document states.

This TAO unit is born of the Internet -- created in 1997, a time when not even 2 percent of the world's population had Internet access and no one had yet thought of Facebook, YouTube or Twitter. From the time the first TAO employees moved into offices at NSA headquarters in Fort Meade, Maryland, the unit was housed in a separate wing, set apart from the rest of the agency. Their task was clear from the beginning -- to work around the clock to find ways to hack into global communications traffic.

Recruiting the Geeks

To do this, the NSA needed a new kind of employee. The TAO workers authorized to access the special, secure floor on which the unit is located are for the most part considerably younger than the average NSA staff. Their job is breaking into, manipulating and exploiting computer networks, making them hackers and civil servants in one. Many resemble geeks -- and act the part too.

Indeed, it is from these very circles that the NSA recruits new hires for its Tailored Access Operations unit. In recent years, NSA Director Keith Alexander has made several appearances at major hacker conferences in the United States. Sometimes, Alexander wears his military uniform, but at others, he even dons jeans and a t-shirt in his effort to court trust and a new generation of employees.

The recruitment strategy seems to have borne fruit. Certainly, few if any other divisions within the agency are growing as quickly as TAO. There are now TAO units in Wahiawa, Hawaii; Fort Gordon, Georgia; at the NSA's outpost at Buckley Air Force Base, near Denver, Colorado; at its headquarters in Fort Meade; and, of course, in San Antonio.

One trail also leads to Germany. According to a document dating from 2010 that lists the "Lead TAO Liaisons" domestically and abroad as well as names, email addresses and the number for their "Secure Phone," a liaison office is located near Frankfurt -- the European Security Operations Center (ESOC) at the so-called "Dagger Complex" at a US military compound in the Griesheim suburb of Darmstadt.

But it is the growth of the unit's Texas branch that has been uniquely impressive, the top secret documents reviewed by SPIEGEL show. These documents reveal that in 2008, the Texas Cryptologic Center employed fewer than 60 TAO specialists. By 2015, the number is projected to grow to 270 employees. In addition, there are another 85 specialists in the "Requirements & Targeting" division (up from 13 specialists in 2008). The number of software developers is expected to increase from the 2008 level of three to 38 in 2015. The San Antonio office handles attacks against targets in the Middle East, Cuba, Venezuela and Colombia, not to mention Mexico, just 200 kilometers (124 miles) away, where the government has fallen into the NSA's crosshairs.



Targeting Mexico

Mexico's Secretariat of Public Security, which was folded into the new National Security Commission at the beginning of 2013, was responsible at the time for the country's police, counterterrorism, prison system and border police. Most of the agency's nearly 20,000 employees worked at its headquarters on Avenida Constituyentes, an important traffic artery in Mexico City. A large share of the Mexican security authorities under the auspices of the Secretariat are supervised from the offices there, making Avenida Constituyentes a one-stop shop for anyone seeking to learn more about the country's security apparatus.
Operation WHITETAMALE

That considered, assigning the TAO unit responsible for tailored operations to target the Secretariat makes a lot of sense. After all, one document states, the US Department of Homeland Security and the United States' intelligence agencies have a need to know everything about the drug trade, human trafficking and security along the US-Mexico border. The Secretariat presents a potential "goldmine" for the NSA's spies, a document states. The TAO workers selected systems administrators and telecommunications engineers at the Mexican agency as their targets, thus marking the start of what the unit dubbed Operation WHITETAMALE.

Workers at NSA's target selection office, which also had Angela Merkel in its sights in 2002 before she became chancellor, sent TAO a list of officials within the Mexican Secretariat they thought might make interesting targets. As a first step, TAO penetrated the target officials' email accounts, a relatively simple job. Next, they infiltrated the entire network and began capturing data.

Soon the NSA spies had knowledge of the agency's servers, including IP addresses, computers used for email traffic and individual addresses of diverse employees. They also obtained diagrams of the security agencies' structures, including video surveillance. It appears the operation continued for years until SPIEGEL first reported on it in October.

The technical term for this type of activity is "Computer Network Exploitation" (CNE). The goal here is to "subvert endpoint devices," according to an internal NSA presentation that SPIEGEL has viewed. The presentation goes on to list nearly all the types of devices that run our digital lives -- "servers, workstations, firewalls, routers, handsets, phone switches, SCADA systems, etc." SCADAs are industrial control systems used in factories, as well as in power plants. Anyone who can bring these systems under their control has the potential to knock out parts of a country's critical infrastructure.

The most well-known and notorious use of this type of attack was the development of Stuxnet, the computer worm whose existence was discovered in June 2010. The virus was developed jointly by American and Israeli intelligence agencies to sabotage Iran's nuclear program, and successfully so. The country's nuclear program was set back by years after Stuxnet manipulated the SCADA control technology used at Iran's uranium enrichment facilities in Natanz, rendering up to 1,000 centrifuges unusable.

The special NSA unit has its own development department in which new technologies are developed and tested. This division is where the real tinkerers can be found, and their inventiveness when it comes to finding ways to infiltrate other networks, computers and smartphones evokes a modern take on Q, the legendary gadget inventor in James Bond movies.

Having Fun at Microsoft's Expense

One example of the sheer creativity with which the TAO spies approach their work can be seen in a hacking method they use that exploits the error-proneness of Microsoft's Windows. Every user of the operating system is familiar with the annoying window that occasionally pops up on screen when an internal problem is detected, an automatic message that prompts the user to report the bug to the manufacturer and to restart the program. These crash reports offer TAO specialists a welcome opportunity to spy on computers.

When TAO selects a computer somewhere in the world as a target and enters its unique identifiers (an IP address, for example) into the corresponding database, intelligence agents are then automatically notified any time the operating system of that computer crashes and its user receives the prompt to report the problem to Microsoft. An internal presentation suggests it is NSA's powerful XKeyscore spying tool that is used to fish these crash reports out of the massive sea of Internet traffic.

The automated crash reports are a "neat way" to gain "passive access" to a machine, the presentation continues. Passive access means that, initially, only data the computer sends out into the Internet is captured and saved, but the computer itself is not yet manipulated. Still, even this passive access to error messages provides valuable insights into problems with a targeted person's computer and, thus, information on security holes that might be exploitable for planting malware or spyware on the unwitting victim's computer.

Although the method appears to have little importance in practical terms, the NSA's agents still seem to enjoy it because it allows them to have a bit of a laugh at the expense of the Seattle-based software giant. In one internal graphic, they replaced the text of Microsoft's original error message with one of their own reading, "This information may be intercepted by a foreign sigint system to gather detailed information and better exploit your machine." ("Sigint" stands for "signals intelligence.")

One of the hackers' key tasks is the offensive infiltration of target computers with so-called implants or with large numbers of Trojans. They've bestowed their spying tools with illustrious monikers like "ANGRY NEIGHBOR," "HOWLERMONKEY" or "WATERWITCH." These names may sound cute, but the tools they describe are both aggressive and effective.

According to details in Washington's current budget plan for the US intelligence services, around 85,000 computers worldwide are projected to be infiltrated by the NSA specialists by the end of this year. By far the majority of these "implants" are conducted by TAO teams via the Internet.

Increasing Sophistication

Until just a few years ago, NSA agents relied on the same methods employed by cyber criminals to conduct these implants on computers. They sent targeted attack emails disguised as spam containing links directing users to virus-infected websites. With sufficient knowledge of an Internet browser's security holes -- Microsoft's Internet Explorer, for example, is especially popular with the NSA hackers -- all that is needed to plant NSA malware on a person's computer is for that individual to open a website that has been specially crafted to compromise the user's computer. Spamming has one key drawback though: It doesn't work very often.

Nevertheless, TAO has dramatically improved the tools at its disposal. It maintains a sophisticated toolbox known internally by the name "QUANTUMTHEORY." "Certain QUANTUM missions have a success rate of as high as 80%, where spam is less than 1%," one internal NSA presentation states.

A comprehensive internal presentation titled "QUANTUM CAPABILITIES," which SPIEGEL has viewed, lists virtually every popular Internet service provider as a target, including Facebook, Yahoo, Twitter and YouTube. "NSA QUANTUM has the greatest success against Yahoo, Facebook and static IP addresses," it states. The presentation also notes that the NSA has been unable to employ this method to target users of Google services. Apparently, that can only be done by Britain's GCHQ intelligence service, which has acquired QUANTUM tools from the NSA.

A favored tool of intelligence service hackers is "QUANTUMINSERT." GCHQ workers used this method to attack the computers of employees at partly government-held Belgian telecommunications company Belgacom, in order to use their computers to penetrate even further into the company's networks. The NSA, meanwhile, used the same technology to target high-ranking members of the Organization of the Petroleum Exporting Countries (OPEC) at the organization's Vienna headquarters. In both cases, the trans-Atlantic spying consortium gained unhindered access to valuable economic data using these tools.



The NSA's Shadow Network

The insert method and other variants of QUANTUM are closely linked to a shadow network operated by the NSA alongside the Internet, with its own, well-hidden infrastructure comprised of "covert" routers and servers. It appears the NSA also incorporates routers and servers from non-NSA networks into its covert network by infecting these networks with "implants" that then allow the government hackers to control the computers remotely. In this way, the intelligence service seeks to identify and track its targets based on their digital footprints. These identifiers could include certain email addresses or website cookies set on a person's computer. Of course, a cookie doesn't automatically identify a person, but it can if it includes additional information like an email address. In that case, a cookie becomes something like the web equivalent of a fingerprint.

A Race Between Servers

Once TAO teams have gathered sufficient data on their targets' habits, they can shift into attack mode, programming the QUANTUM systems to perform this work in a largely automated way. If a data packet featuring the email address or cookie of a target passes through a cable or router monitored by the NSA, the system sounds the alarm. It determines what website the target person is trying to access and then activates one of the intelligence service's covert servers, known by the codename FOXACID.

This NSA server coerces the user into connecting to NSA covert systems rather than the intended sites. In the case of Belgacom engineers, instead of reaching the LinkedIn page they were actually trying to visit, they were also directed to FOXACID servers housed on NSA networks. Undetected by the user, the manipulated page transferred malware already custom tailored to match security holes on the target person's computer.

The technique can literally be a race between servers, one that is described in internal intelligence agency jargon with phrases like: "Wait for client to initiate new connection," "Shoot!" and "Hope to beat server-to-client response." Like any competition, at times the covert network's surveillance tools are "too slow to win the race." Often enough, though, they are effective. Implants with QUANTUMINSERT, especially when used in conjunction with LinkedIn, now have a success rate of over 50 percent, according to one internal document.

Tapping Undersea Cables

At the same time, it is in no way true to say that the NSA has its sights set exclusively on select individuals. Of even greater interest are entire networks and network providers, such as the fiber optic cables that direct a large share of global Internet traffic along the world's ocean floors.

One document labeled "top secret" and "not for foreigners" describes the NSA's success in spying on the "SEA-ME-WE-4" cable system. This massive underwater cable bundle connects Europe with North Africa and the Gulf states and then continues on through Pakistan and India, all the way to Malaysia and Thailand. The cable system originates in southern France, near Marseille. Among the companies that hold ownership stakes in it are France Telecom, now known as Orange and still partly government-owned, and Telecom Italia Sparkle.

The document proudly announces that, on Feb. 13, 2013, TAO "successfully collected network management information for the SEA-Me-We Undersea Cable Systems (SMW-4)." With the help of a "website masquerade operation," the agency was able to "gain access to the consortium's management website and collected Layer 2 network information that shows the circuit mapping for significant portions of the network."

It appears the government hackers succeeded here once again using the QUANTUMINSERT method.

The document states that the TAO team hacked an internal website of the operator consortium and copied documents stored there pertaining to technical infrastructure. But that was only the first step. "More operations are planned in the future to collect more information about this and other cable systems," it continues.

But numerous internal announcements of successful attacks like the one against the undersea cable operator aren't the exclusive factors that make TAO stand out at the NSA. In contrast to most NSA operations, TAO's ventures often require physical access to their targets. After all, you might have to directly access a mobile network transmission station before you can begin tapping the digital information it provides.

Spying Traditions Live On

To conduct those types of operations, the NSA works together with other intelligence agencies such as the CIA and FBI, which in turn maintain informants on location who are available to help with sensitive missions. This enables TAO to attack even isolated networks that aren't connected to the Internet. If necessary, the FBI can even make an agency-owned jet available to ferry the high-tech plumbers to their target. This gets them to their destination at the right time and can help them to disappear again undetected after even as little as a half hour's work.

Responding to a query from SPIEGEL, NSA officials issued a statement saying, "Tailored Access Operations is a unique national asset that is on the front lines of enabling NSA to defend the nation and its allies." The statement added that TAO's "work is centered on computer network exploitation in support of foreign intelligence collection." The officials said they would not discuss specific allegations regarding TAO's mission.

Sometimes it appears that the world's most modern spies are just as reliant on conventional methods of reconnaissance as their predecessors.

Take, for example, when they intercept shipping deliveries. If a target person, agency or company orders a new computer or related accessories, for example, TAO can divert the shipping delivery to its own secret workshops. The NSA calls this method interdiction. At these so-called "load stations," agents carefully open the package in order to load malware onto the electronics, or even install hardware components that can provide backdoor access for the intelligence agencies. All subsequent steps can then be conducted from the comfort of a remote computer.

These minor disruptions in the parcel shipping business rank among the "most productive operations" conducted by the NSA hackers, one top secret document relates in enthusiastic terms. This method, the presentation continues, allows TAO to obtain access to networks "around the world."

Even in the Internet Age, some traditional spying methods continue to live on.

Catalog Advertises NSA Toolbox

After years of speculation that electronics can be accessed by intelligence agencies through a back door, an internal NSA catalog reveals that such methods already exist for numerous end-user devices.

When it comes to modern firewalls for corporate computer networks, the world's second largest network equipment manufacturer doesn't skimp on praising its own work. According to Juniper Networks' online PR copy, the company's products are "ideal" for protecting large companies and computing centers from unwanted access from outside. They claim the performance of the company's special computers is "unmatched" and their firewalls are the "best-in-class." Despite these assurances, though, there is one attacker none of these products can fend off -- the United States' National Security Agency.

Specialists at the intelligence organization succeeded years ago in penetrating the company's digital firewalls. A document viewed by SPIEGEL resembling a product catalog reveals that an NSA division called ANT has burrowed its way into nearly all the security architecture made by the major players in the industry -- including American global market leader Cisco and its Chinese competitor Huawei, but also producers of mass-market goods, such as US computer-maker Dell.

A 50-Page Catalog

These NSA agents, who specialize in secret back doors, are able to keep an eye on all levels of our digital lives -- from computing centers to individual computers, from laptops to mobile phones. For nearly every lock, ANT seems to have a key in its toolbox. And no matter what walls companies erect, the NSA's specialists seem already to have gotten past them.

This, at least, is the impression gained from flipping through the 50-page document. The list reads like a mail-order catalog, one from which other NSA employees can order technologies from the ANT division for tapping their targets' data. The catalog even lists the prices for these electronic break-in tools, with costs ranging from free to $250,000.

In the case of Juniper, the name of this particular digital lock pick is "FEEDTROUGH." This malware burrows into Juniper firewalls and makes it possible to smuggle other NSA programs into mainframe computers. Thanks to FEEDTROUGH, these implants can, by design, even survive "across reboots and software upgrades." In this way, US government spies can secure themselves a permanent presence in computer networks. The catalog states that FEEDTROUGH "has been deployed on many target platforms."

Master Carpenters

The specialists at ANT, which presumably stands for Advanced or Access Network Technology, could be described as master carpenters for the NSA's department for Tailored Access Operations (TAO). In cases where TAO's usual hacking and data-skimming methods don't suffice, ANT workers step in with their special tools, penetrating networking equipment, monitoring mobile phones and computers and diverting or even modifying data. Such "implants," as they are referred to in NSA parlance, have played a considerable role in the intelligence agency's ability to establish a global covert network that operates alongside the Internet.

Some of the equipment available is quite inexpensive. A rigged monitor cable that allows "TAO personnel to see what is displayed on the targeted monitor," for example, is available for just $30. But an "active GSM base station" -- a tool that makes it possible to mimic a mobile phone tower and thus monitor cell phones -- costs a full $40,000. Computer bugging devices disguised as normal USB plugs, capable of sending and receiving data via radio undetected, are available in packs of 50 for over $1 million.

'Persistence'

The ANT division doesn't just manufacture surveillance hardware. It also develops software for special tasks. The ANT developers have a clear preference for planting their malicious code in so-called BIOS, software located on a computer's motherboard that is the first thing to load when a computer is turned on.

This has a number of valuable advantages: an infected PC or server appears to be functioning normally, so the infection remains invisible to virus protection and other security programs. And even if the hard drive of an infected computer has been completely erased and a new operating system is installed, the ANT malware can continue to function and ensures that new spyware can once again be loaded onto what is presumed to be a clean computer. The ANT developers call this "Persistence" and believe this approach has provided them with the possibility of permanent access.

Another program attacks the firmware in hard drives manufactured by Western Digital, Seagate, Maxtor and Samsung, all of which, with the exception of latter, are American companies. Here, too, it appears the US intelligence agency is compromising the technology and products of American companies.

Other ANT programs target Internet routers meant for professional use or hardware firewalls intended to protect company networks from online attacks. Many digital attack weapons are "remotely installable" -- in other words, over the Internet. Others require a direct attack on an end-user device -- an "interdiction," as it is known in NSA jargon -- in order to install malware or bugging equipment.

There is no information in the documents seen by SPIEGEL to suggest that the companies whose products are mentioned in the catalog provided any support to the NSA or even had any knowledge of the intelligence solutions. "Cisco does not work with any government to modify our equipment, nor to implement any so-called security 'back doors' in our products," the company said in a statement. Contacted by SPIEGEL reporters, officials at Western Digital, Juniper Networks and Huawei also said they had no knowledge of any such modifications. Meanwhile, Dell officials said the company "respects and complies with the laws of all countries in which it operates."

Many of the items in the software solutions catalog date from 2008, and some of the target server systems that are listed are no longer on the market today. At the same time, it's not as if the hackers within the ANT division have been sleeping on the job. They have continued to develop their arsenal. Some pages in the 2008 catalog, for example, list new systems for which no tools yet exist. However, the authors promise they are already hard at work developing new tools and that they will be "pursued for a future release".

N.S.A. Devises Radio Pathway Into Computers

WASHINGTON — The National Security Agency has implanted software in nearly 100,000 computers around the world that allows the United States to conduct surveillance on those machines and can also create a digital highway for launching cyberattacks.

While most of the software is inserted by gaining access to computer networks, the N.S.A. has increasingly made use of a secret technology that enables it to enter and alter data in computers even if they are not connected to the Internet, according to N.S.A. documents, computer experts and American officials.

The technology, which the agency has used since at least 2008, relies on a covert channel of radio waves that can be transmitted from tiny circuit boards and USB cards inserted surreptitiously into the computers. In some cases, they are sent to a briefcase-size relay station that intelligence agencies can set up miles away from the target.


The radio frequency technology has helped solve one of the biggest problems facing American intelligence agencies for years: getting into computers that adversaries, and some American partners, have tried to make impervious to spying or cyberattack. In most cases, the radio frequency hardware must be physically inserted by a spy, a manufacturer or an unwitting user.

The N.S.A. calls its efforts more an act of “active defense” against foreign cyberattacks than a tool to go on the offensive. But when Chinese attackers place similar software on the computer systems of American companies or government agencies, American officials have protested, often at the presidential level.

Among the most frequent targets of the N.S.A. and its Pentagon partner, United States Cyber Command, have been units of the Chinese Army, which the United States has accused of launching regular digital probes and attacks on American industrial and military targets, usually to steal secrets or intellectual property. But the program, code-named Quantum, has also been successful in inserting software into Russian military networks and systems used by the Mexican police and drug cartels, trade institutions inside the European Union, and sometime partners against terrorism like Saudi Arabia, India and Pakistan, according to officials and an N.S.A. map that indicates sites of what the agency calls “computer network exploitation.”

“What’s new here is the scale and the sophistication of the intelligence agency’s ability to get into computers and networks to which no one has ever had access before,” said James Andrew Lewis, the cybersecurity expert at the Center for Strategic and International Studies in Washington. “Some of these capabilities have been around for a while, but the combination of learning how to penetrate systems to insert software and learning how to do that using radio frequencies has given the U.S. a window it’s never had before.”

No Domestic Use Seen

There is no evidence that the N.S.A. has implanted its software or used its radio frequency technology inside the United States. While refusing to comment on the scope of the Quantum program, the N.S.A. said its actions were not comparable to China’s.

“N.S.A.'s activities are focused and specifically deployed against — and only against — valid foreign intelligence targets in response to intelligence requirements,” Vanee Vines, an agency spokeswoman, said in a statement. “We do not use foreign intelligence capabilities to steal the trade secrets of foreign companies on behalf of — or give intelligence we collect to — U.S. companies to enhance their international competitiveness or increase their bottom line.”

Over the past two months, parts of the program have been disclosed in documents from the trove leaked by Edward J. Snowden, the former N.S.A. contractor. A Dutch newspaper published the map of areas where the United States has inserted spy software, sometimes in cooperation with local authorities, often covertly. Der Spiegel, a German newsmagazine, published the N.S.A.'s catalog of hardware products that can secretly transmit and receive digital signals from computers, a program called ANT. The New York Times withheld some of those details, at the request of American intelligence officials, when it reported, in the summer of 2012, on American cyberattacks on Iran.

President Obama is scheduled to announce on Friday what recommendations he is accepting from an advisory panel on changing N.S.A. practices. The panel agreed with Silicon Valley executives that some of the techniques developed by the agency to find flaws in computer systems undermine global confidence in a range of American-made information products like laptop computers and cloud services.

Embracing Silicon Valley’s critique of the N.S.A., the panel has recommended banning, except in extreme cases, the N.S.A. practice of exploiting flaws in common software to aid in American surveillance and cyberattacks. It also called for an end to government efforts to weaken publicly available encryption systems, and said the government should never develop secret ways into computer systems to exploit them, which sometimes include software implants.

Richard A. Clarke, an official in the Clinton and Bush administrations who served as one of the five members of the advisory panel, explained the group’s reasoning in an email last week, saying that “it is more important that we defend ourselves than that we attack others.”

“Holes in encryption software would be more of a risk to us than a benefit,” he said, adding: “If we can find the vulnerability, so can others. It’s more important that we protect our power grid than that we get into China’s.”

From the earliest days of the Internet, the N.S.A. had little trouble monitoring traffic because a vast majority of messages and searches were moved through servers on American soil. As the Internet expanded, so did the N.S.A.'s efforts to understand its geography. A program named Treasure Map tried to identify nearly every node and corner of the web, so that any computer or mobile device that touched it could be located.

A 2008 map, part of the Snowden trove, notes 20 programs to gain access to big fiber-optic cables — it calls them “covert, clandestine or cooperative large accesses” — not only in the United States but also in places like Hong Kong, Indonesia and the Middle East. The same map indicates that the United States had already conducted “more than 50,000 worldwide implants,” and a more recent budget document said that by the end of last year that figure would rise to about 85,000. A senior official, who spoke on the condition of anonymity, said the actual figure was most likely closer to 100,000.

That map suggests how the United States was able to speed ahead with implanting malicious software on the computers around the world that it most wanted to monitor — or disable before they could be used to launch a cyberattack.

A Focus on Defense

In interviews, officials and experts said that a vast majority of such implants are intended only for surveillance and serve as an early warning system for cyberattacks directed at the United States.

“How do you ensure that Cyber Command people” are able to look at “those that are attacking us?” a senior official, who compared it to submarine warfare, asked in an interview several months ago.

“That is what the submarines do all the time,” said the official, speaking on the condition of anonymity to describe policy. “They track the adversary submarines.” In cyberspace, he said, the United States tries “to silently track the adversaries while they’re trying to silently track you.”

If tracking subs was a Cold War cat-and-mouse game with the Soviets, tracking malware is a pursuit played most aggressively with the Chinese.

The United States has targeted Unit 61398, the Shanghai-based Chinese Army unit believed to be responsible for many of the biggest cyberattacks on the United States, in an effort to see attacks being prepared. With Australia’s help, one N.S.A. document suggests, the United States has also focused on another specific Chinese Army unit.

Documents obtained by Mr. Snowden indicate that the United States has set up two data centers in China — perhaps through front companies — from which it can insert malware into computers. When the Chinese place surveillance software on American computer systems — and they have, on systems like those at the Pentagon and at The Times — the United States usually regards it as a potentially hostile act, a possible prelude to an attack. Mr. Obama laid out America’s complaints about those practices to President Xi Jinping of China in a long session at a summit meeting in California last June.

At that session, Mr. Obama tried to differentiate between conducting surveillance for national security — which the United States argues is legitimate — and conducting it to steal intellectual property.

“The argument is not working,” said Peter W. Singer of the Brookings Institution, a co-author of a new book called “Cybersecurity and Cyberwar.” “To the Chinese, gaining economic advantage is part of national security. And the Snowden revelations have taken a lot of the pressure off” the Chinese. Still, the United States has banned the sale of computer servers from a major Chinese manufacturer, Huawei, for fear that they could contain technology to penetrate American networks.

An Old Technology

The N.S.A.'s efforts to reach computers unconnected to a network have relied on a century-old technology updated for modern times: radio transmissions.

In a catalog produced by the agency that was part of the Snowden documents released in Europe, there are page after page of devices using technology that would have brought a smile to Q, James Bond’s technology supplier.

One, called Cottonmouth I, looks like a normal USB plug but has a tiny transceiver buried in it. According to the catalog, it transmits information swept from the computer “through a covert channel” that allows “data infiltration and exfiltration.” Another variant of the technology involves tiny circuit boards that can be inserted in a laptop computer — either in the field or when they are shipped from manufacturers — so that the computer is broadcasting to the N.S.A. even while the computer’s user enjoys the false confidence that being walled off from the Internet constitutes real protection.

The relay station it communicates with, called Nightstand, fits in an oversize briefcase, and the system can attack a computer “from as far away as eight miles under ideal environmental conditions.” It can also insert packets of data in milliseconds, meaning that a false message or piece of programming can outrace a real one to a target computer. Similar stations create a link between the target computers and the N.S.A., even if the machines are isolated from the Internet.

Computers are not the only targets. Dropoutjeep attacks iPhones. Other hardware and software are designed to infect large network servers, including those made by the Chinese.

Most of those code names and products are now at least five years old, and they have been updated, some experts say, to make the United States less dependent on physically getting hardware into adversaries’ computer systems.

The N.S.A. refused to talk about the documents that contained these descriptions, even after they were published in Europe.

“Continuous and selective publication of specific techniques and tools used by N.S.A. to pursue legitimate foreign intelligence targets is detrimental to the security of the United States and our allies,” Ms. Vines, the N.S.A. spokeswoman, said.

But the Iranians and others discovered some of those techniques years ago. The hardware in the N.S.A.'s catalog was crucial in the cyberattacks on Iran’s nuclear facilities, code-named Olympic Games, that began around 2008 and proceeded through the summer of 2010, when a technical error revealed the attack software, later called Stuxnet. That was the first major test of the technology.

One feature of the Stuxnet attack was that the technology the United States slipped into Iran’s nuclear enrichment plant at Natanz was able to map how it operated, then “phone home” the details. Later, that equipment was used to insert malware that blew up nearly 1,000 centrifuges, and temporarily set back Iran’s program.

But the Stuxnet strike does not appear to be the last time the technology was used in Iran. In 2012, a unit of the Islamic Revolutionary Guards Corps moved a rock near the country’s underground Fordo nuclear enrichment plant. The rock exploded and spewed broken circuit boards that the Iranian news media described as “the remains of a device capable of intercepting data from computers at the plant.” The origins of that device have never been determined.

On Sunday, according to the semiofficial Fars news agency, Iran’s Oil Ministry issued another warning about possible cyberattacks, describing a series of defenses it was erecting — and making no mention of what are suspected of being its own attacks on Saudi Arabia’s largest oil producer.

Feldman: No matter what Barack Obama said, the NSA is still spying on you

Bothered that the government has the metadata from all your calls, so that it can map out the details of your life at the click of a button? If you really are, little in President Barack Obama's much-hyped speech on intelligence gathering should allay your concerns.

True, Obama announced that he would "end" the metadata- collection program "as it currently exists." But he never explained how, ignoring the recommendations of his own handpicked review group and instead asking his administration for new technical options on the bulk storage of data by the end of March.

If you remember the president's promise to close the prison at Guantanamo Bay, Cuba, you know that "ending" something means doing it subject to realistic constraints - which may keep the program from ending at all. And if you don't have short-term amnesia, you'll recall that the Obama administration isn't exactly bristling with skilled high-tech advisers who can build complicated new solutions to technological problems.


The president must have realized that skeptics might be unimpressed by a promise to try to do something unspecified at an indeterminate future time. So he added some reforms related to the bulk collection of metadata that could be implemented right away. In one, he announced that the intelligence community would from now on only "pursue phone calls that are two steps removed from a number associated with a terrorist organization instead of three." In the other, he directed the attorney general to arrange that "during this transition period" the database would be queried "only after a judicial finding, or in a true emergency."

On the surface, these proposals sound pretty substantial - but they aren't. In a game of Six Degrees of Osama bin Laden, the move from three "hops" to two is minimal. If the suspected target phone numbers belong to people in the United States, the odds are good that they have called some widely used number - the Comcast helpline, for example. Anyone else who has ever called that number would still be within bounds. Your friends' friends are still two hops away, even if your friends' friends' friends' are now not within the standard range. Ask yourself: Would the intelligence community have agreed to the three to two reduction if they thought it would substantially reduce their capacity to monitor terrorists?

Querying the bulk database only after a judicial finding sounds much better. Yet the president never said that he was talking about an individualized or specific judicial finding. The Foreign Intelligence Surveillance Court has already approved the most general requests imaginable. Those that already exist could well be included in the words "after a judicial finding" - which would mean no change at all during this "transition." And what, pray tell, counts as a "true emergency" in the context of counterterrorism?

As for the longer-term solutions, the president could have announced that the government would no longer hold onto the bulk-collected metadata. The review panel recommended this change. And it was no congeries of radicals. The five men included, among others, Michael Morell, the former deputy Central Intelligence Agency director; Richard Clarke, White House counterterrorism adviser under Bill Clinton and George W. Bush; and former Obama administration official (and my Harvard and Bloomberg View colleague) Cass Sunstein.

Obama rejected the group's recommendation of leaving the metadata with the companies that generated it in the first place. His proffered explanation was that that relying on the telecommunications companies might require them "to alter their procedures in ways that raise new privacy concerns." Maybe - but the argument misses the very essence of the liberty to privacy that is involved here.

When you make a phone call, you know the telephone company has the information about that call. But you trust the telephone company not to exploit that information to track your patterns of movement and affiliation (at least not without your consent), because it is a private firm that would be heavily criticized if it did so.

The government, on the other hand, is a completely different story. Without specific legal or constitutional prohibitions on accessing your metadata, the government has no reason whatever not to sneak a look.

Put another way, I may have privacy interests relative to my phone carrier, but I don't have privacy rights unless the law creates them. And constitutional rights, at least, are in U.S. restricted to protecting me against the government, not against private parties acting entirely on their own.

All this comes back to the question of whether you really care that the government might be looking. One way to read the minimal changes suggested by Obama's speech is that the administration is gambling that you don't. The public may have been temporarily upset by Edward Snowden's revelations. But to the extent We the People are made up of Gmail users, we simply may not care that much about metadata privacy. If this is right, there will be no significant negative reaction to Obama's speech, and the intelligence community can get back to business more or less as usual.

Left on the margin will be those of us who, in our old- fashioned way, think that the government's intrusions into our privacy are more to be feared than private industry's - and that the Constitution was designed to protect us from the government that is itself supposed to protect us.

The list of those caught up in the global surveillance net cast by the National Security Agency and its overseas partners, from social media users to foreign heads of state, now includes another entry: American lawyers.

A top-secret document, obtained by the former N.S.A. contractor Edward J. Snowden, shows that an American law firm was monitored while representing a foreign government in trade disputes with the United States. The disclosure offers a rare glimpse of a specific instance in which Americans were ensnared by the eavesdroppers, and is of particular interest because lawyers in the United States with clients overseas have expressed growing concern that their confidential communications could be compromised by such surveillance.

The government of Indonesia had retained the law firm for help in trade talks, according to the February 2013 document. It reports that the N.S.A.’s Australian counterpart, the Australian Signals Directorate, notified the agency that it was conducting surveillance of the talks, including communications between Indonesian officials and the American law firm, and offered to share the information.

The Australians told officials at an N.S.A. liaison office in Canberra, Australia, that “information covered by attorney-client privilege may be included” in the intelligence gathering, according to the document, a monthly bulletin from the Canberra office. The law firm was not identified, but Mayer Brown, a Chicago-based firm with a global practice, was then advising the Indonesian government on trade issues.

On behalf of the Australians, the liaison officials asked the N.S.A. general counsel’s office for guidance about the spying. The bulletin notes only that the counsel’s office “provided clear guidance” and that the Australian agency “has been able to continue to cover the talks, providing highly useful intelligence for interested US customers.”

The N.S.A. declined to answer questions about the reported surveillance, including whether information involving the American law firm was shared with United States trade officials or negotiators.

Duane Layton, a Mayer Brown lawyer involved in the trade talks, said he did not have any evidence that he or his firm had been under scrutiny by Australian or American intelligence agencies. “I always wonder if someone is listening, because you would have to be an idiot not to wonder in this day and age,” he said in an interview. “But I’ve never really thought I was being spied on.”

A Rising Concern for Lawyers

Most attorney-client conversations do not get special protections under American law from N.S.A. eavesdropping. Amid growing concerns about surveillance and hacking, the American Bar Association in 2012 revised its ethics rules to explicitly require lawyers to “make reasonable efforts” to protect confidential information from unauthorized disclosure to outsiders.

Last year, the Supreme Court, in a 5-to-4 decision, rebuffed a legal challenge to a 2008 law allowing warrantless wiretapping that was brought in part by lawyers with foreign clients they believed were likely targets of N.S.A. monitoring. The lawyers contended that the law raised risks that required them to take costly measures, like traveling overseas to meet clients, to protect sensitive communications. But the Supreme Court dismissed their fears as “speculative.”

The N.S.A. is prohibited from targeting Americans, including businesses, law firms and other organizations based in the United States, for surveillance without warrants, and intelligence officials have repeatedly said the N.S.A. does not use the spy services of its partners in the so-called Five Eyes alliance — Australia, Britain, Canada and New Zealand — to skirt the law.

Still, the N.S.A.can intercept the communications of Americans if they are in contact with a foreign intelligence target abroad, such as Indonesian officials. The N.S.A. is then required to follow so-called minimization rules to protect their privacy, such as deleting the identity of Americans or information that is not deemed necessary to understand or assess the foreign intelligence, before sharing it with other agencies.

An N.S.A. spokeswoman said the agency’s Office of the General Counsel was consulted when issues of potential attorney-client privilege arose and could recommend steps to protect such information.

“Such steps could include requesting that collection or reporting by a foreign partner be limited, that intelligence reports be written so as to limit the inclusion of privileged material and to exclude U.S. identities, and that dissemination of such reports be limited and subject to appropriate warnings or restrictions on their use,” said Vanee M. Vines, the spokeswoman.

The Australian government declined to comment about the surveillance. In a statement, the Australian Defense Force public affairs office said that in gathering information to support Australia’s national interests, its intelligence agencies adhered strictly to their legal obligations, including when they engaged with foreign counterparts.Several newly disclosed documents provide details of the cooperation between the United States and Australia, which share facilitiesand highly sensitive intelligence, including efforts to break encryption and collect phone call data in Indonesia. Both nations have trade and security interests in Indonesia, where Islamic terrorist groups that threaten the West have bases.

The 2013 N.S.A. bulletin did not identify which trade case was being monitored by Australian intelligence, but Indonesia has been embroiled in several disputes with the United States in recent years. One involves clove cigarettes, an Indonesian export. The Indonesian government has protested to the World Trade Organization a United States ban on their sale, arguing that similar menthol cigarettes have not been subject to the same restrictions under American antismoking laws. The trade organization, ruling that the United States prohibition violated international trade laws, referred the case to arbitration to determine potential remedies for Indonesia.

Another dispute involved Indonesia’s exports of shrimp, which the United States claimed were being sold at below-market prices.

The Indonesian government retained Mayer Brown to help in the cases concerning cigarettes and shrimp, said Ni Made Ayu Marthini, attaché for trade and industry at the Indonesian Embassy in Washington. She said no American law firm had been formally retained yet to help in a third case, involving horticultural and animal products.

Mr. Layton, a lawyer in the Washington office of Mayer Brown, said that since 2010 he had led a team from the firm in the clove cigarette dispute. He said Matthew McConkey, another lawyer in the firm’s Washington office, had taken the lead on the shrimp issue until the United States dropped its claims in August. Both cases were underway a year ago when the Australians reported that their surveillance included an American law firm.

Mr. Layton said that if his emails and calls with Indonesian officials had been monitored, the spies would have been bored. “None of this stuff is very sexy,” he said. “It’s just run of the mill.”


He and the other Mayer Brown lawyers do most of their work on the trade issues from Washington, he said. They also make occasional trips to Jakarta, Indonesia’s capital, and Geneva, where the World Trade Organization is based. Mr. Layton said most of his communications with officials in Jakarta had been done through email, while he also talked by phone with officials at the Indonesian Embassy in Washington.

The N.S.A.’s protections for attorney-client conversations are narrowly crafted, said Stephen Gillers, an expert on legal ethics at New York University’s School of Law. The agency is barred from sharing with prosecutors intercepted attorney-client communications involving someone under indictment in the United States, according to previously disclosed N.S.A. rules. But the agency may still use or share the information for intelligence purposes.

Andrew M. Perlman, a Suffolk University law professor who specializes in legal ethics and technology issues, said the growth of surveillance was troubling for lawyers. He helped create the bar association’s ethics code revisions that require lawyers to try to avoid being overheard by eavesdroppers.

“You run out of options very quickly to communicate with someone overseas,” he said. “Given the difficulty of finding anything that is 100 percent secure, lawyers are in a difficult spot to ensure that all of the information remains in confidence.”

In addition to its work on trade issues with the United States, Mr. Layton said, Mayer Brown was representing Indonesia in a dispute with Australia. He said Indonesia had been arguing that Australia’s requirements for plain packaging for tobacco products under its antismoking rules were excessive.

Economic Espionage

Even though the Indonesian issues were relatively modest for the United States — about $40 million in annual trade is related to the clove cigarette dispute and $1 billion annually to shrimp — the Australian surveillance of talks underscores the extent to which the N.S.A. and its close partners engage in economic espionage.

In justifying the agency’s sweeping powers, the Obama administration often emphasizes the N.S.A.’s role in fighting terrorism and cyberattacks, but disclosures in recent months from the documents leaked by Mr. Snowden show the agency routinely spies on trade negotiations, communications of economic officials in other countries and even foreign corporations.

American intelligence officials do not deny that they collect economic information from overseas, but argue that they do not engage in industrial espionage by sharing that information with American businesses. China, for example, is often accused of stealing business secrets from Western corporations and passing them to Chinese corporations.

The N.S.A. trade document — headlined “SUSLOC (Special US Liaison Office Canberra) Facilitates Sensitive DSD Reporting on Trade Talks”— does not say which “interested US customers” besides the N.S.A. might have received intelligence on the trade dispute.

Other documents obtained from Mr. Snowden reveal that the N.S.A. shares reports from its surveillance widely among civilian agencies. A 2004 N.S.A. document, for example, describes how the agency’s intelligence gathering was critical to the Agriculture Department in international trade negotiations.

“The U.S.D.A. is involved in trade operations to protect and secure a large segment of the U.S. economy,” that document states. Top agency officials “often rely on SIGINT” — short for the signals intelligence that the N.S.A. eavesdropping collects — “to support their negotiations.”

The Australians reported another instance to the N.S.A. — in addition to the one with the American law firm — in which their spying involved an American, according to the February 2013 document. They were conducting surveillance on a target who turned out to be an American working for the United States government in Afghanistan, the document said. It offered no details about what happened after the N.S.A. learned of the incident, and the agency declined to respond to questions about it.

In a statement, Ms. Vines, the agency spokeswoman, said: “N.S.A. works with a number of partners in meeting its foreign-intelligence mission goals, and those operations comply with U.S. law and with the applicable laws under which those partners operate. A key part of the protections that apply to both U.S. persons and citizens of other countries is the mandate that information be in support of a valid foreign-intelligence requirement, and comply with U.S. attorney general-approved procedures to protect privacy rights.”

The documents show that the N.S.A. and the Australians jointly run a large signals intelligence facility in Alice Springs, Australia, with half the personnel from the American agency. The N.S.A. and its Australian counterpart have also cooperated on efforts to defeat encryption. A 2003 memo describes how N.S.A. personnel sought to “mentor” the Australians while they tried to break the encryption used by the armed forces of nearby Papua New Guinea.

Most of the collaboration between the N.S.A. and the Australian eavesdropping service is focused on Asia, with China and Indonesia receiving special attention.

Australian intelligence has focused heavily on Indonesia since the Bali bombing of 2002. The attack, which killed 202 people, including 88 Australians, in a resort area popular with Australians, was blamed on the Southeast Asian Islamist group Jemaah Islamiyah.

The Americans and the Australians secretly share broad access to the Indonesian telecommunications system, the documents show. The N.S.A. has given the Australians access to bulk call data from Indosat, an Indonesian telecommunications provider, according to a 2012 agency document. That includes data on Indonesian government officials in various ministries, the document states.

The Australians have obtained nearly 1.8 million encrypted master keys, which are used to protect private communications, from the Telkomsel mobile telephone network in Indonesia, and developed a way to decrypt almost all of them, according to a 2013 N.S.A. document.

Britain's surveillance agency GCHQ, with aid from the US National Security Agency, intercepted and stored the webcam images of millions of internet users not suspected of wrongdoing, secret documents reveal.

GCHQ files dating between 2008 and 2010 explicitly state that a surveillance program codenamed Optic Nerve collected still images of Yahoo webcam chats in bulk and saved them to agency databases, regardless of whether individual users were an intelligence target or not.

In one six-month period in 2008 alone, the agency collected webcam imagery – including substantial quantities of sexually explicit communications – from more than 1.8 million Yahoo user accounts globally.

Yahoo reacted furiously to the webcam interception when approached by the Guardian. The company denied any prior knowledge of the program, accusing the agencies of "a whole new level of violation of our users' privacy".

GCHQ does not have the technical means to make sure no images of UK or US citizens are collected and stored by the system, and there are no restrictions under UK law to prevent Americans' images being accessed by British analysts without an individual warrant.

The documents also chronicle GCHQ's sustained struggle to keep the large store of sexually explicit imagery collected by Optic Nerve away from the eyes of its staff, though there is little discussion about the privacy implications of storing this material in the first place.

NSA surveillance program reaches ‘into the past’ to retrieve, replay phone calls

The National Security Agency has built a surveillance system capable of recording “100 percent” of a foreign country’s telephone calls, enabling the agency to rewind and review conversations as long as a month after they take place, according to people with direct knowledge of the effort and documents supplied by former contractor Edward Snowden.

A senior manager for the program compares it to a time machine — one that can replay the voices from any call without requiring that a person be identified in advance for surveillance.


The voice interception program, called MYSTIC, began in 2009. Its RETRO tool, short for “retrospective retrieval,” and related projects reached full capacity against the first target nation in 2011. Planning documents two years later anticipated similar operations elsewhere.

In the initial deployment, collection systems are recording “every single” conversation nationwide, storing billions of them in a 30-day rolling buffer that clears the oldest calls as new ones arrive, according to a classified summary.

The call buffer opens a door “into the past,” the summary says, enabling users to “retrieve audio of interest that was not tasked at the time of the original call.” Analysts listen to only a fraction of 1 percent of the calls, but the absolute numbers are high. Each month, they send millions of voice clippings, or “cuts,” for processing and long-term storage.

At the request of U.S. officials, The Washington Post is withholding details that could be used to identify the country where the system is being employed or other countries where its use was envisioned.

No other NSA program disclosed to date has swallowed a nation’s telephone network whole. Outside experts have sometimes described that prospect as disquieting but remote, with notable implications for a growing debate over the NSA’s practice of “bulk collection” abroad.

Bulk methods capture massive data flows “without the use of discriminants,” as President Obama put it in January. By design, they vacuum up all the data they touch — meaning that most of the conversations collected by RETRO would be irrelevant to U.S. national security interests.

In the view of U.S. officials, however, the capability is highly valuable.

In a statement, Caitlin Hayden, spokeswoman for the National Security Council, declined to comment on “specific alleged intelligence activities.” Speaking generally, she said that “new or emerging threats” are “often hidden within the large and complex system of modern global communications, and the United States must consequently collect signals intelligence in bulk in certain circumstances in order to identify these threats.”

NSA spokeswoman Vanee Vines, in an e-mailed statement, said that “continuous and selective reporting of specific techniques and tools used for legitimate U.S. foreign intelligence activities is highly detrimental to the national security of the United States and of our allies, and places at risk those we are sworn to protect.”

Some of the documents provided by Snowden suggest that high-volume eavesdropping may soon be extended to other countries, if it has not been already. The RETRO tool was built three years ago as a “unique one-off capability,” but last year’s secret intelligence budget named five more countries for which the MYSTIC program provides “comprehensive metadata access and content,” with a sixth expected to be in place by last October.

The budget did not say whether the NSA now records calls in quantity in those countries or expects to do so. A separate document placed a high priority on planning “for MYSTIC accesses against projected new mission requirements,” including “voice.”

Ubiquitous voice surveillance, even overseas, pulls in a great deal of content from Americans who telephone, visit and work in the target country. It may also be seen as inconsistent with Obama’s Jan. 17 pledge “that the United States is not spying on ordinary people who don’t threaten our national security,” regardless of nationality, “and that we take their privacy concerns into account.”

In a presidential policy directive, Obama instructed the NSA and other agencies that bulk acquisition may be used only to gather intelligence related to one of six specified threats, including nuclear proliferation and terrorism. The directive, however, also noted that limits on bulk collection “do not apply to signals intelligence data that is temporarily acquired to facilitate targeted collection.”

The emblem of the MYSTIC program depicts a cartoon wizard with a telephone-headed staff. Among the agency’s bulk collection programs disclosed over the past year, its focus on the spoken word is unique. Most of the programs have involved the bulk collection of metadata — which does not include call content — or text, such as e-mail address books.

Telephone calls are often thought to be more ephemeral and less suited than text for processing, storage and search. And there are indications that the call-recording program has been hindered by the NSA’s limited capacity to store and transmit bulky voice files.

In the first year of its deployment, a program officer wrote that the project “has long since reached the point where it was collecting and sending home far more than the bandwidth could handle.”

Because of similar capacity limits across a range of collection programs, the NSA is leaping forward with cloud-based collection systems and a gargantuan new “mission data repository” in Utah. According to its overview briefing, the Utah facility is designed “to cope with the vast increases in digital data that have accompanied the rise of the global network.”

Christopher Soghoian, the principal technologist for the American Civil Liberties Union, said history suggests that “over the next couple of years they will expand to more countries, retain data longer and expand the secondary uses.”

Spokesmen for the NSA and the office of Director of National Intelligence James R. Clapper Jr. declined to confirm or deny expansion plans or discuss the criteria for any change.

Based on RETRO’s internal reviews, the NSA has a strong motive to deploy it elsewhere. In the documents and in interviews, U.S. officials said RETRO is uniquely valuable when an analyst uncovers a new name or telephone number of interest.

With up to 30 days of recorded conversations in hand, the NSA can pull an instant history of the subject’s movements, associates and plans. Some other U.S. intelligence agencies also have access to RETRO.

Highly classified briefings cite examples in which the tool offered high-stakes intelligence that would not have existed under traditional surveillance programs in which subjects are identified for targeting in advance. In contrast with most of the government’s public claims about the value of controversial programs, the briefings supply names, dates, locations and fragments of intercepted calls in convincing detail.

Present and former U.S. officials, speaking on the condition of anonymity to provide context for a classified program, acknowledged that large numbers of conversations involving Americans would be gathered from the country where RETRO operates.

The NSA does not attempt to filter out their calls, defining them as communications “acquired incidentally as a result of collection directed against appropriate foreign intelligence targets.”

Until about 20 years ago, such incidental collection was unusual unless an American was communicating directly with a foreign intelligence target. In bulk collection systems, which are exponentially more capable than the ones in use throughout the Cold War, calls and other data from U.S. citizens and permanent residents are regularly ingested by the millions.

Under the NSA’s internal “minimization rules,” those intercepted communications “may be retained and processed” and included in intelligence reports. The agency generally removes the names of U.S. callers, but there are several broadly worded exceptions.

An independent group tasked by the White House to review U.S. surveillance policies recommended that incidentally collected U.S. calls and e-mails — including those obtained overseas — should nearly always “be purged upon detection.” Obama did not accept that recommendation.

Vines, in her statement, said the NSA’s work is “strictly conducted under the rule of law.”

RETRO and MYSTIC are carried out under Executive Order 12333, the traditional grant of presidential authority to intelligence agencies for operations outside the United States.

Since August, Sen. Dianne Feinstein (D-Calif.), the chairman of the Senate Intelligence Committee, and others on that panel have been working on plans to assert a greater oversight role for intelligence-gathering abroad. Some legislators are considering whether Congress should also draft new laws to govern those operations.

Experts say there is not much legislation that governs overseas intelligence work.

“Much of the U.S. government’s intelligence collection is not regulated by any statute passed by Congress,” said Timothy H. Edgar, the former director of privacy and civil liberties on Obama’s national security staff. “There’s a lot of focus on the Foreign Intelligence Surveillance Act, which is understandable, but that’s only a slice of what the intelligence community does.”

All surveillance must be properly authorized for a legitimate intelligence purpose, he said, but that “still leaves a gap for activities that otherwise basically aren’t regulated by law, because they’re not covered by FISA.”

Beginning in 2007, Congress loosened 40-year-old restrictions on domestic surveillance because so much foreign data crossed U.S. territory. There were no comparable changes to protect the privacy of U.S. citizens and residents whose calls and e-mails now routinely cross international borders.

Vines noted that the NSA’s job is to “identify threats within the large and complex system of modern global communications,” in which ordinary people share fiber-optic cables with legitimate intelligence targets.

For Peter Swire, a member of the president’s review group, the fact that Americans and foreigners use the same devices, software and networks calls for greater care to safeguard Americans’ privacy.

“It’s important to have institutional protections so that advanced capabilities used overseas don’t get turned against our democracy at home,” he said.

NSA Said to Exploit Heartbleed Bug for Intelligence for Years

The U.S. National Security Agency knew for at least two years about a flaw in the way that many websites send sensitive information, now dubbed the Heartbleed bug, and regularly used it to gather critical intelligence, two people familiar with the matter said.

The agency’s reported decision to keep the bug secret in pursuit of national security interests threatens to renew the rancorous debate over the role of the government’s top computer experts. The NSA, after declining to comment on the report, subsequently denied that it was aware of Heartbleed until the vulnerability was made public by a private security report earlier this month.

“Reports that NSA or any other part of the government were aware of the so-called Heartbleed vulnerability before 2014 are wrong,” according to an e-mailed statement from the Office of the Director of National Intelligence.

Putting the Heartbleed bug in its arsenal, the NSA was able to obtain passwords and other basic data that are the building blocks of the sophisticated hacking operations at the core of its mission, but at a cost. Millions of ordinary users were left vulnerable to attack from other nations’ intelligence arms and criminal hackers.

Controversial Practice
“It flies in the face of the agency’s comments that defense comes first,” said Jason Healey, director of the cyber statecraft initiative at the Atlantic Council and a former Air Force cyber officer. “They are going to be completely shredded by the computer security community for this.”

Experts say the search for flaws is central to NSA’s mission, though the practice is controversial. A presidential board reviewing the NSA’s activities after Edward Snowden’s leaks recommended the agency halt the stockpiling of software vulnerabilities.

When new vulnerabilities of the Heartbleed type are discovered, they are disclosed, the Office of the Director of National Intelligence said in response to the Bloomberg report. A clear process exists among agencies for deciding when to share vulnerabilities, the office said in a statement.

“This administration takes seriously its responsibility to help maintain an open, interoperable, secure and reliable Internet,” Shawn Turner, director of public affairs for the office, said in the statement. “Unless there is a clear national security or law enforcement need, this process is biased toward responsibly disclosing such vulnerabilities.”

Hunting Flaws
The NSA and other elite intelligence agencies devote millions of dollars to hunt for common software flaws that are critical to stealing data from secure computers. Open-source protocols like OpenSSL, where the flaw was found, are primary targets.

The Heartbleed flaw, introduced in early 2012 in a minor adjustment to the OpenSSL protocol, highlights one of the failings of open source software development.

While many Internet companies rely on the free code, its integrity depends on a small number of underfunded researchers who devote their energies to the projects.

In contrast, the NSA has more than 1,000 experts devoted to ferreting out such flaws using sophisticated analysis techniques, many of them classified. The agency found Heartbleed shortly after its introduction, according to one of the people familiar with the matter, and it became a basic part of the agency’s toolkit for stealing account passwords and other common tasks.

NSA Spying
The NSA has faced nine months of withering criticism for the breadth of its spying, documented in a rolling series of leaks from Snowden, who was a former agency contractor.

The revelations have created a clearer picture of the two roles, sometimes contradictory, played by the U.S.’s largest spy agency. The NSA protects the computers of the government and critical industry from cyber-attacks, while gathering troves of intelligence attacking the computers of others, including terrorist organizations, nuclear smugglers and other governments.

Ordinary Internet users are ill-served by the arrangement because serious flaws are not fixed, exposing their data to domestic and international spy organizations and criminals, said John Pescatore, director of emerging security trends at the SANS Institute, a Bethesda, Maryland-based cyber-security training organization.

One Agency
“If you combine the two into one government agency, which mission wins?” asked Pescatore, who formerly worked in security for the NSA and the U.S. Secret Service. “Invariably when this has happened over time, the offensive mission wins.”

When researchers uncovered the Heartbleed bug hiding in plain sight and made it public on April 7, it underscored an uncomfortable truth: The public may be placing too much trust in software and hardware developers to insure the security of our most sensitive transactions.

“We’ve never seen any quite like this,” said Michael Sutton, vice president of security research at Zscaler, a San Jose, California-based security firm. “Not only is a huge portion of the Internet impacted, but the damage that can be done, and with relative ease, is immense.”

The potential stems from a flawed implementation of protocol used to encrypt communications between users and websites protected by OpenSSL, making those supposedly secure sites an open book. The damage could be done with relatively simple scans, so that millions of machines could be hit by a single attacker.

Exploiting Flaw
Questions remain about whether anyone other than the U.S. government might have exploited the flaw before the public disclosure. Sophisticated intelligence agencies in other countries are one possibility.

If criminals found the flaw before a fix was published this week, they could have scooped up troves of passwords for bank accounts, e-commerce sites and e-mail accounts worldwide.

Evidence of that is so far lacking, and it’s possible that cybercriminals missed the potential in the same way security professionals did, suggested Tal Klein, vice president of marketing at Adallom, in Menlo Park, California.

The fact that the vulnerability existed in the transmission of ordinary data -- even if it’s the kind of data the vast majority of users are concerned about -- may have been a factor in the decision by NSA officials to keep it a secret, said James Lewis, a cybersecurity senior fellow at the Center for Strategic and International Studies.

Determining Risk
“They actually have a process when they find this stuff that goes all the way up to the director” of the agency, Lewis said. “They look at how likely it is that other guys have found it and might be using it, and they look at what’s the risk to the country.”

Lewis said the NSA has a range of options, including exploiting the vulnerability to gain intelligence for a short period of time and then discreetly contacting software makers or open source researchers to fix it.

The SSL protocol has a history of security problems, Lewis said, and is not the primary form of protection governments and others use to transmit highly sensitive information.

“I knew hackers who could break it nearly 15 years ago,” Lewis said of the SSL protocol.

That may not soothe the millions of users who were left vulnerable for so long.

Panel’s Recommendation
Following the leaks about NSA’s electronic spying, President Barack Obama convened a panel to review surveillance activities and suggest reforms. Among the dozens of changes put forward was a recommendation that the NSA quickly move to fix software flaws rather that exploit them, and that they be used only in “rare instances” and for short periods of time.

“If the NSA knows about a vulnerability, then often other nation states and even criminal organizations can exploit the same security vulnerability,” said Harley Geiger, senior counsel for the Center for Democracy & Technology in Washington. “What may be a good tool for the NSA may also turn out to be a tool for organizations that are less ethical or have no ethics at all.”

Currently, the NSA has a trove of thousands of such vulnerabilities that can be used to breach some of the world’s most sensitive computers, according to a person briefed on the matter. Intelligence chiefs have said the country’s ability to spot terrorist threats and understand the intent of hostile leaders would be vastly diminished if their use were prohibited.

Data Pirates of the Caribbean: The NSA Is Recording Every Cell Phone Call in the Bahamas

The National Security Agency is secretly intercepting, recording, and archiving the audio of virtually every cell phone conversation on the island nation of the Bahamas.

According to documents provided by NSA whistleblower Edward Snowden, the surveillance is part of a top-secret system – code-named SOMALGET – that was implemented without the knowledge or consent of the Bahamian government. Instead, the agency appears to have used access legally obtained in cooperation with the U.S. Drug Enforcement Administration to open a backdoor to the country’s cellular telephone network, enabling it to covertly record and store the “full-take audio” of every mobile call made to, from and within the Bahamas – and to replay those calls for up to a month.

SOMALGET is part of a broader NSA program called MYSTIC, which The Intercept has learned is being used to secretly monitor the telecommunications systems of the Bahamas and several other countries, including Mexico, the Philippines, and Kenya. But while MYSTIC scrapes mobile networks for so-called “metadata” – information that reveals the time, source, and destination of calls – SOMALGET is a cutting-edge tool that enables the NSA to vacuum up and store the actual content of every conversation in an entire country.

All told, the NSA is using MYSTIC to gather personal data on mobile calls placed in countries with a combined population of more than 250 million people. And according to classified documents, the agency is seeking funding to export the sweeping surveillance capability elsewhere.

The program raises profound questions about the nature and extent of American surveillance abroad. The U.S. intelligence community routinely justifies its massive spying efforts by citing the threats to national security posed by global terrorism and unpredictable rival nations like Russia and Iran. But the NSA documents indicate that SOMALGET has been deployed in the Bahamas to locate “international narcotics traffickers and special-interest alien smugglers” – traditional law-enforcement concerns, but a far cry from derailing terror plots or intercepting weapons of mass destruction.

“The Bahamas is a stable democracy that shares democratic principles, personal freedoms, and rule of law with the United States,” the State Department concluded in a crime and safety report published last year. “There is little to no threat facing Americans from domestic (Bahamian) terrorism, war, or civil unrest.”

By targeting the Bahamas’ entire mobile network, the NSA is intentionally collecting and retaining intelligence on millions of people who have not been accused of any crime or terrorist activity. Nearly five million Americans visit the country each year, and many prominent U.S. citizens keep homes there, including Sen. Tom Harkin (D-Iowa), Bill Gates, and Oprah Winfrey.

In addition, the program is a serious – and perhaps illegal – abuse of the access to international phone networks that other countries willingly grant the United States for legitimate law-enforcement surveillance. If the NSA is using the Drug Enforcement Administration’s relationship to the Bahamas as a cover for secretly recording the entire country’s mobile phone calls, it could imperil the longstanding tradition of international law enforcement cooperation that the United States enjoys with its allies.

“It’s surprising, the short-sightedness of the government,” says Michael German, a fellow at New York University’s Brennan Center for Justice who spent 16 years as an FBI agent conducting undercover investigations. “That they couldn’t see how exploiting a lawful mechanism to such a degree that you might lose that justifiable access – that’s where the intelligence community is acting in a way that harms its long-term interests, and clearly the long-term national security interests of the United States.”

The NSA refused to comment on the program, but said in a statement that “the implication that NSA’s foreign intelligence collection is arbitrary and unconstrained is false.” The agency also insisted that it follows procedures to “protect the privacy of U.S. persons” whose communications are “incidentally collected.”

Informed about the NSA’s spying, neither the Bahamian prime minister’s office nor the country’s national security minister had any comment. The embassies of Mexico, Kenya, and the Philippines did not respond to phone messages and emails.

In March, The Washington Post revealed that the NSA had developed the capability to record and store an entire nation’s phone traffic for 30 days. The Post reported that the capacity was a feature of MYSTIC, which it described as a “voice interception program” that is fully operational in one country and proposed for activation in six others. (The Post also referred to NSA documents suggesting that MYSTIC was pulling metadata in some of those countries.) Citing government requests, the paper declined to name any of those countries.

The Intercept has confirmed that as of 2013, the NSA was actively using MYSTIC to gather cell-phone metadata in five countries, and was intercepting voice data in two of them. Documents show that the NSA has been generating intelligence reports from MYSTIC surveillance in the Bahamas, Mexico, Kenya, the Philippines, and one other country, which The Intercept is not naming in response to specific, credible concerns that doing so could lead to increased violence. The more expansive full-take recording capability has been deployed in both the Bahamas and the unnamed country.

MYSTIC was established in 2009 by the NSA’s Special Source Operations division, which works with corporate partners to conduct surveillance. Documents in the Snowden archive describe it as a “program for embedded collection systems overtly installed on target networks, predominantly for the collection and processing of wireless/mobile communications networks.”

If an entire nation’s cell-phone calls were a menu of TV shows, MYSTIC would be a cable programming guide showing which channels offer which shows, and when. SOMALGET would be the DVR that automatically records every show on every channel and stores them for a month. MYSTIC provides the access; SOMALGET provides the massive amounts of storage needed to archive all those calls so that analysts can listen to them at will after the fact. According to one NSA document, SOMALGET is “deployed against entire networks” in the Bahamas and the second country, and processes “over 100 million call events per day.”

SOMALGET’s capabilities are further detailed in a May 2012 memo written by an official in the NSA’s International Crime and Narcotics division. The memo hails the “great success” the NSA’s drugs and crime unit has enjoyed through its use of the program, and boasts about how “beneficial” the collection and recording of every phone call in a given nation can be to intelligence analysts.

Rather than simply making “tentative analytic conclusions derived from metadata,” the memo notes, analysts can follow up on hunches by going back in time and listening to phone calls recorded during the previous month. Such “retrospective retrieval” means that analysts can figure out what targets were saying even when the calls occurred before the targets were identified. “[W]e buffer certain calls that MAY be of foreign intelligence value for a sufficient period to permit a well-informed decision on whether to retrieve and return specific audio content,” the NSA official reported.

“There is little reason,” the official added, that SOMALGET could not be expanded to more countries, as long as the agency provided adequate engineering, coordination and hardware. There is no indication in the documents that the NSA followed up on the official’s enthusiasm.

The documents don’t spell out how the NSA has been able to tap the phone calls of an entire country. But one memo indicates that SOMALGET data is covertly acquired under the auspices of “lawful intercepts” made through Drug Enforcement Administration “accesses”– legal wiretaps of foreign phone networks that the DEA requests as part of international law enforcement cooperation.

When U.S. drug agents need to tap a phone of a suspected drug kingpin in another country, they call up their counterparts and ask them set up an intercept. To facilitate those taps, many nations – including the Bahamas – have hired contractors who install and maintain so-called lawful intercept equipment on their telecommunications. With SOMALGET, it appears that the NSA has used the access those contractors developed to secretly mine the country’s entire phone system for “signals intelligence” –recording every mobile call in the country. “Host countries,” the document notes, “are not aware of NSA’s SIGINT collection.”

“Lawful intercept systems engineer communications vulnerabilities into networks, forcing the carriers to weaken,” says Christopher Soghoian, the principal technologist for the American Civil Liberties Union. “Host governments really should be thinking twice before they accept one of these Trojan horses.”

The DEA has long been in a unique position to help the NSA gain backdoor access to foreign phone networks. “DEA has close relationships with foreign government counterparts and vetted foreign partners,” the manager of the NSA’s drug-war efforts reported in a 2004 memo. Indeed, with more than 80 international offices, the DEA is one of the most widely deployed U.S. agencies around the globe.

But what many foreign governments fail to realize is that U.S. drug agents don’t confine themselves to simply fighting narcotics traffickers. “DEA is actually one of the biggest spy operations there is,” says Finn Selander, a former DEA special agent who works with the drug-reform advocacy group Law Enforcement Against Prohibition. “Our mandate is not just drugs. We collect intelligence.”

What’s more, Selander adds, the NSA has aided the DEA for years on surveillance operations. “On our reports, there’s drug information and then there’s non-drug information,” he says. “So countries let us in because they don’t view us, really, as a spy organization.”

Selander’s first-hand experience is echoed in the 2004 memo by the manager of the NSA’s drug-war efforts, which was titled “DEA: The Other Warfighter.” The DEA and the NSA “enjoy a vibrant two-way information-sharing relationship,” the memo observes, and cooperate so closely on counternarcotics and counterterrorism that there is a risk of “blurring the lines between the two missions.”

Still, the ability to record and replay the phone calls of an entire country appears to be a relatively new weapon in the NSA’s arsenal. None of the half-dozen former U.S. law enforcement officials interviewed by The Intercept said they had ever heard of a surveillance operation quite like the NSA’s Bahamas collection.

“I’m completely unfamiliar with the program,” says Joel Margolis, a former DEA official who is now executive vice president of government affairs for Subsentio, a Colorado-based company that installs lawful intercepts for telecommunications providers. “I used to work in DEA’s office of chief counsel, and I was their lead specialist on lawful surveillance matters. I wasn’t aware of anything like this.”

For nearly two decades, telecom providers in the United States have been legally obligated under the 1994 Communications Assistance for Law Enforcement Act to build their networks with wiretapping capabilities, providing law enforcement agencies with access to more efficient, centrally managed surveillance.

Since CALEA’s passage, many countries have adopted similar measures, making it easier to gather telecommunications intelligence for international investigations. A 2001 working group for the United Nations Office on Drugs and Crime went so far as to urge countries to consider permitting foreign law enforcement agencies to initiate international wiretaps directly from within their own territories.

The process for setting up lawful intercepts in foreign countries is largely the same as in the United States. “Law enforcement issues a warrant or other authorization, a carrier or a carrier’s agent responds to the warrant by provisioning the intercept, and the information is sent in sort of a one-way path to the law enforcement agency,” says Marcus Thomas, a former FBI assistant director who now serves as chief technology officer for Subsentio.

When U.S. drug agents wiretap a country’s phone networks, they must comply with the host country’s laws and work alongside their law enforcement counterparts. “The way DEA works with our allies – it could be Bahamas or Jamaica or anywhere – the host country has to invite us,” says Margolis. “We come in and provide the support, but they do the intercept themselves.”

The Bahamas’ Listening Devices Act requires all wiretaps to be authorized in writing either by the minister of national security or the police commissioner in consultation with the attorney general. The individuals to be targeted must be named. Under the nation’s Data Protection Act, personal data may only be “collected by means which are both lawful and fair in the circumstances of the case.” The office of the Bahamian data protection commissioner, which administers the act, said in a statement that it “was not aware of the matter you raise.”

Countries like the Bahamas don’t install lawful intercepts on their own. With the adoption of international standards, a thriving market has emerged for private firms that are contracted by foreign governments to install and maintain lawful intercept equipment. Currently valued at more than $128 million, the global market for private interception services is expected to skyrocket to more than $970 million within the next four years, according to a 2013 report from the research firm Markets and Markets.

“Most telecom hardware vendors will have some solutions for legal interception,” says a former mobile telecommunications engineer who asked not to be named because he is currently working for the British government. “That’s pretty much because legal interception is a requirement if you’re going to operate a mobile phone network.”

The proliferation of private contractors has apparently provided the NSA with direct access to foreign phone networks. According to the documents, MYSTIC draws its data from “collection systems” that were overtly installed on the telecommunications systems of targeted countries, apparently by corporate “partners” cooperating with the NSA.

One NSA document spells out that “the overt purpose” given for accessing foreign telecommunications systems is “for legitimate commercial service for the Telco’s themselves.” But the same document adds: “Our covert mission is the provision of SIGINT,” or signals intelligence.

The classified 2013 intelligence budget also describes MYSTIC as using “partner-enabled” access to both cellular and landline phone networks. The goal of the access, the budget says, is to “provide comprehensive metadata access and content against targeted communications” in the Caribbean, Mexico, Kenya, the Philippines, and the unnamed country. The budget adds that in the Bahamas, Mexico, and the Philippines, MYSTIC requires “contracted services” for its “operational sustainment.”

The NSA documents don’t specify who is providing access in the Bahamas. But they do describe SOMALGET as an “umbrella term” for systems provided by a private firm, which is described elsewhere in the documents as a “MYSTIC access provider.” (The documents don’t name the firm, but rather refer to a cover name that The Intercept has agreed not to publish in response to a specific, credible concern that doing so could lead to violence.) Communications experts consulted byThe Intercept say the descriptions in the documents suggest a company able to install lawful intercept equipment on phone networks.

Though it is not the “access provider,” the behemoth NSA contractor General Dynamics is directly involved in both MYSTIC and SOMALGET. According to documents, the firm has an eight-year, $51 million contract to process “all MYSTIC data and data for other NSA accesses” at a facility in Annapolis Junction, Maryland, down the road from NSA’s headquarters. NSA logs of SOMALGET collection activity – communications between analysts about issues such as outages and performance problems – contain references to a technician at a “SOMALGET processing facility” who bears the same name as a LinkedIn user listing General Dynamics as his employer. Reached for comment, a General Dynamics spokesperson referred questions to the NSA.

According to the NSA documents, MYSTIC targets calls and other data transmitted on Global System for Mobile Communications networks – the primary framework used for cell phone calls worldwide. In the Philippines, MYSTIC collects “GSM, Short Message Service (SMS) and Call Detail Records” via access provided by a “DSD asset in a Philippine provider site.” (The DSD refers to the Defence Signals Directorate, an arm of Australian intelligence. The Australian consulate in New York declined to comment.) The operation in Kenya is “sponsored” by the CIA, according to the documents, and collects “GSM metadata with the potential for content at a later date.” The Mexican operation is likewise sponsored by the CIA. The documents don’t say how or under what pretenses the agency is gathering call data in those countries.

In the Bahamas, the documents say, the NSA intercepts GSM data that is transmitted over what is known as the “A link”–or “A interface”–a core component of many mobile networks. The A link transfers data between two crucial parts of GSM networks – the base station subsystem, where phones in the field communicate with cell towers, and the network subsystem, which routes calls and text messages to the appropriate destination. “It’s where all of the telephone traffic goes,” says the former engineer.

Punching into this portion of a county’s mobile network would give the NSA access to a virtually non-stop stream of communications. It would also require powerful technology.

“I seriously don’t think that would be your run-of-the-mill legal interception equipment,” says the former engineer, who worked with hardware and software that typically maxed out at 1,000 intercepts. The NSA, by contrast, is recording and storing tens of millions of calls – “mass surveillance,” he observes, that goes far beyond the standard practices for lawful interception recognized around the world.

The Bahamas Telecommunications Company did not respond to repeated phone calls and emails.

If the U.S. government wanted to make a case for surveillance in the Bahamas, it could point to the country’s status as a leading haven for tax cheats, corporate shell games, and a wide array of black-market traffickers. The State Department considers the Bahamas both a “major drug-transit country” and a “major money laundering country” (a designation it shares with more than 60 other nations, including the U.S.). According to the International Monetary Fund, as of 2011 the Bahamas was home to 271 banks and trust companies with active licenses. At the time, the Bahamian banks held $595 billion in U.S. assets.

But the NSA documents don’t reflect a concerted focus on the money launderers and powerful financial institutions – including numerous Western banks – that underpin the black market for narcotics in the Bahamas. Instead, an internal NSA presentation from 2013 recounts with pride how analysts used SOMALGET to locate an individual who “arranged Mexico-to-United States marijuana shipments” through the U.S. Postal Service.

The presentation doesn’t say whether the NSA shared the information with the DEA. But the drug agency’s Special Operations Divison has come under fire for improperly using classified information obtained by the NSA to launch criminal investigations – and then creating false narratives to mislead courts about how the investigations began. The tactic – known as parallel construction – was first reported by Reuters last year, and is now under investigation by the Justice Department’s inspector general.

So: Beyond a desire to bust island pot dealers, why would the NSA choose to apply a powerful collection tool such as SOMALGET against the Bahamas, which poses virtually no threat to the United States?

The answer may lie in a document that characterizes the Bahamas operation as a “test bed for system deployments, capabilities, and improvements” to SOMALGET. The country’s small population – fewer than 400,000 residents – provides a manageable sample to try out the surveillance system’s features. Since SOMALGET is also operational in one other country, the Bahamas may be used as a sort of guinea pig to beta-test improvements and alterations without impacting the system’s operations elsewhere.

“From an engineering point of view it makes perfect sense,” says the former engineer. “Absolutely.”

Beyond the Bahamas, the other countries being targeted by MYSTIC are more in line with the NSA’s more commonly touted priorities. In Kenya, the U.S. works closely with local security forces in combating the militant fundamentalist group Al-Shabab, based in neighboring Somalia. In the Philippines, the U.S. continues to support a bloody shadow war against Islamist extremists launched by the Bush administration in 2002. Last month, President Barack Obama visited Manila to sign a military pact guaranteeing that U.S. operations in Southeast Asia will continue and expand for at least another decade.

Mexico, another country targeted by MYSTIC, has received billions of dollars in police, military, and intelligence aid from the U.S. government over the past seven years to fight the war on drugs, a conflict that has left more than 70,000 Mexicans dead by some estimates. Attorney General Eric Holder has described Mexican drug cartels as a U.S. “national security threat,” and in 2009, then-CIA director Michael Hayden said the violence and chaos in Mexico would soon be the second greatest security threat facing the U.S. behind Al Qaeda.

The legality of the NSA’s sweeping surveillance in the Bahamas is unclear, given the permissive laws under which the U.S intelligence community operates. Earlier this year, President Obama issued a policy directive imposing “new limits” on the U.S. intelligence community’s use of “signals intelligence collected in bulk.” In addition to threats against military or allied personnel, the directive lists five broad conditions under which the agency would be permitted to trawl for data in unrestricted dragnets: threats posed by foreign powers, terrorism, weapons of mass destruction, cybersecurity, and “transnational criminal threats, including illicit finance and sanctions evasion.”

SOMALGET operates under Executive Order 12333, a Reagan-era rule establishing wide latitude for the NSA and other intelligence agencies to spy on other countries, as long as the attorney general is convinced the efforts are aimed at gathering foreign intelligence. In 2000, the NSA assured Congress that all electronic surveillance performed under 12333 “must be conducted in a manner that minimizes the acquisition, retention, and dissemination of information about unconsenting U.S. persons.” In reality, many legal experts point out, the lack of judicial oversight or criminal penalties for violating the order render the guidelines meaningless.

“I think it would be open, whether it was legal or not,” says German, the former FBI agent. “Because we don’t have all the facts about how they’re doing it. For a long time, the NSA has been interpreting their authority in the broadest possible way, even beyond what an objective observer would say was reasonable.”

“An American citizen has Fourth Amendment rights wherever they are,” adds Kurt Opsahl, an attorney with the Electronic Frontier Foundation. “Nevertheless, there have certainly been a number of things published over the last year which suggest that there are broad, sweeping programs that the NSA and other government agencies are doing abroad that sweep up the communications of Americans.”

Legal or not, the NSA’s covert surveillance of an entire nation suggests that it will take more than the president’s tepid “limits” to rein in the ambitions of the intelligence community. “It’s almost like they have this mentality – if we can, we will,” says German. “There’s no analysis of the long-term risks of doing it, no analysis of whether it’s actually worth the effort, no analysis of whether we couldn’t take those resources and actually put them on real threats and do more good.”

It’s not surprising, German adds, that the government’s covert program in the Bahamas didn’t remain covert. “The undermining of international law and international cooperation is such a long-term negative result of these programs that they had to know would eventually be exposed, whether through a leak, whether through a spy, whether through an accident,” he says. “Nothing stays secret forever. It really shows the arrogance of these agencies – they were just going to do what they were going to do, and they weren’t really going to consider any other important aspects of how our long-term security needs to be addressed.”

The real capabilities and behavior of the US surveillance state are almost entirely unknown to the American public because, like most things of significance done by the US government, it operates behind an impenetrable wall of secrecy. But a seemingly spontaneous admission this week by a former FBI counterterrorism agent provides a rather startling acknowledgment of just how vast and invasive these surveillance activities are.

Over the past couple days, cable news tabloid shows such as CNN's Out Front with Erin Burnett have been excitingly focused on the possible involvement in the Boston Marathon attack of Katherine Russell, the 24-year-old American widow of the deceased suspect, Tamerlan Tsarnaev. As part of their relentless stream of leaks uncritically disseminated by our Adversarial Press Corps, anonymous government officials are claiming that they are now focused on telephone calls between Russell and Tsarnaev that took place both before and after the attack to determine if she had prior knowledge of the plot or participated in any way.

On Wednesday night, Burnett interviewed Tim Clemente, a former FBI counterterrorism agent, about whether the FBI would be able to discover the contents of past telephone conversations between the two. He quite clearly insisted that they could:

BURNETT: Tim, is there any way, obviously, there is a voice mail they can try to get the phone companies to give that up at this point. It's not a voice mail. It's just a conversation. There's no way they actually can find out what happened, right, unless she tells them?

CLEMENTE: "No, there is a way. We certainly have ways in national security investigations to find out exactly what was said in that conversation. It's not necessarily something that the FBI is going to want to present in court, but it may help lead the investigation and/or lead to questioning of her. We certainly can find that out.

BURNETT: "So they can actually get that? People are saying, look, that is incredible.

CLEMENTE: "No, welcome to America. All of that stuff is being captured as we speak whether we know it or like it or not."

"All of that stuff" - meaning every telephone conversation Americans have with one another on US soil, with or without a search warrant - "is being captured as we speak".

On Thursday night, Clemente again appeared on CNN, this time with host Carol Costello, and she asked him about those remarks. He reiterated what he said the night before but added expressly that "all digital communications in the past" are recorded and stored:

Let's repeat that last part: "no digital communication is secure", by which he means not that any communication is susceptible to government interception as it happens (although that is true), but far beyond that: all digital communications - meaning telephone calls, emails, online chats and the like - are automatically recorded and stored and accessible to the government after the fact. To describe that is to define what a ubiquitous, limitless Surveillance State is.

There have been some previous indications that this is true. Former AT&T engineer Mark Klein revealed that AT&T and other telecoms had built a special network that allowed the National Security Agency full and unfettered access to data about the telephone calls and the content of email communications for all of their customers. Specifically, Klein explained "that the NSA set up a system that vacuumed up Internet and phone-call data from ordinary Americans with the cooperation of AT&T" and that "contrary to the government's depiction of its surveillance program as aimed at overseas terrorists . . . much of the data sent through AT&T to the NSA was purely domestic." But his amazing revelations were mostly ignored and, when Congress retroactively immunized the nation's telecom giants for their participation in the illegal Bush spying programs, Klein's claims (by design) were prevented from being adjudicated in court.

That every single telephone call is recorded and stored would also explain this extraordinary revelation by the Washington Post in 2010:

Every day, collection systems at the National Security Agency intercept and store 1.7 billion e-mails, phone calls and other types of communications.

It would also help explain the revelations of former NSA official William Binney, who resigned from the agency in protest over its systemic spying on the domestic communications of US citizens, that the US government has "assembled on the order of 20 trillion transactions about US citizens with other US citizens" (which counts only communications transactions and not financial and other transactions), and that "the data that's being assembled is about everybody. And from that data, then they can target anyone they want."

Despite the extreme secrecy behind which these surveillance programs operate, there have been periodic reports of serious abuse. Two Democratic Senators, Ron Wyden and Mark Udall, have been warning for years that Americans would be "stunned" to learn what the US government is doing in terms of secret surveillance.

Strangely, back in 2002 - when hysteria over the 9/11 attacks (and thus acquiescence to government power) was at its peak - the Pentagon's attempt to implement what it called the "Total Information Awareness" program (TIA) sparked so much public controversy that it had to be official scrapped. But it has been incrementally re-instituted - without the creepy (though honest) name and all-seeing-eye logo - with little controversy or even notice.

Back in 2010, worldwide controversy erupted when the governments of Saudi Arabia and the United Arab Emirates banned the use of Blackberries because some communications were inaccessible to government intelligence agencies, and that could not be tolerated. The Obama administration condemned this move on the ground that it threatened core freedoms, only to turn around six weeks later and demand that all forms of digital communications allow the US government backdoor access to intercept them. Put another way, the US government embraced exactly the same rationale invoked by the UAE and Saudi agencies: that no communications can be off limits. Indeed, the UAE, when responding to condemnations from the Obama administration, noted that it was simply doing exactly that which the US government does:

"'In fact, the UAE is exercising its sovereign right and is asking for exactly the same regulatory compliance - and with the same principles of judicial and regulatory oversight - that Blackberry grants the US and other governments and nothing more,' [UAE Ambassador to the US Yousef Al] Otaiba said. 'Importantly, the UAE requires the same compliance as the US for the very same reasons: to protect national security and to assist in law enforcement.'"

That no human communications can be allowed to take place without the scrutinizing eye of the US government is indeed the animating principle of the US Surveillance State. Still, this revelation, made in passing on CNN, that every single telephone call made by and among Americans is recorded and stored is something which most people undoubtedly do not know, even if the small group of people who focus on surveillance issues believed it to be true (clearly, both Burnett and Costello were shocked to hear this).

Some new polling suggests that Americans, even after the Boston attack, are growing increasingly concerned about erosions of civil liberties in the name of Terrorism. Even those people who claim it does not matter instinctively understand the value of personal privacy: they put locks on their bedroom doors and vigilantly safeguard their email passwords. That's why the US government so desperately maintains a wall of secrecy around their surveillance capabilities: because they fear that people will find their behavior unacceptably intrusive and threatening, as they did even back in 2002 when John Poindexter's TIA was unveiled.

Mass surveillance is the hallmark of a tyrannical political culture. But whatever one's views on that, the more that is known about what the US government and its surveillance agencies are doing, the better. This admission by this former FBI agent on CNN gives a very good sense for just how limitless these activities are.
